Battery Waste Management (Amendment) Rules, 2024

Ministry of Environment, Forest and Climate Change (MOEFCC) had notified Battery Waste Management Rules, 2022 in supersession of Batteries (Management and Handling) Rules, 2001 on August 22, 2022. Now, MOEFCC has published Battery Waste Management (Amendment) Rules, 2024 to further amend the Battery Waste Management Rules, 2022 as follows:

  • Substitution of sub-rule 17 in Rule 10 such that CPCB to fix the highest and lowest price for Extended Producer Responsibility certificates which shall be equal to 100% and 30%, respectively of the Environmental Compensation leviable on the obligated entities for non-fulfilment of Extended Producer Responsibility obligations.
  • Insertion of sub rule 18 after sub rule 17 in Rule 10 stating the Exchange Price of EPR Certificate between registered entities through the portal shall be between the highest and the lowest prices referred to in sub-rule (17)
  • Substitution of sub-rule 3 in Rule 13 stating that the CPCB shall prepare and recommend guidelines for imposition and collection of Environmental Compensation from producers and entities involved in refurbishment and recycling of waste battery, in case of non-compliance of these rules.
  • Changes in clause (vi) to (xii) in the table in the entries under column (5) in Schedule II to the said Rules w.r.t the percentage quantity of the battery placed in the market that can be carried forward to the next compliance cycle.
