Exemption to registered shops and commercial establishments in Rajasthan

Exemption to registered shops and commercial establishments from provisions of Section 12(1) of Rajasthan Shops and Commercial Establishments Act, 1958

The State Government of Rajasthan grants an exemption to the shops and commercial establishments registered under the  Rajasthan Shops and Commercial Establishments Act, 1958  from the provisions of section 12(1) (requiring shops and commercial establishments to remain closed one day per week) for a period of three years from the date of publication of this notification in the Rajasthan Gazette, subject to the following conditions:

  1. The employer shall provide a paid weekly holiday to all employed workers on a rotation basis such that each worker gets one full day off per week.
  2. The working hours for employed workers shall be 9 hours per day and 48 hours per week. If workers are required to work beyond these hours, it shall be recorded separately.
  3. Payment for overtime work performed by employed workers shall be made in accordance with the provisions of the Act.
  4. All employed workers shall be issued appointment letters by the employer, and a copy of the same shall be sent to the area inspector. A receipt of this shall be kept on record.
  5. This exemption is only for shops and commercial establishments, and employees will continue to receive all benefits entitled to them under the provisions of the Act.
  6. This exemption is subject to the compliance of the above conditions by the employer and any orders issued by the State Government from time to time.
  7. In case of any violation of the above conditions by a shop or commercial establishment, the granted exemption shall automatically be deemed to be revoked, and the employer will be responsible for any legal action taken under the relevant section and other laws.
