The Companies (Adjudication of Penalties) Second Amendment Rules, 2024 modifies the 2014 Rules under the Companies Act, 2013. It introduces the following key changes:
– A proviso is added to sub-rule (1) of Rule 3A, specifying that any proceedings pending before the Adjudicating Officer or Regional Director at the time of the amendment’s commencement will continue to be governed by the rules as they existed before the amendment.
This ensures that the new rules do not retroactively affect ongoing proceedings. The said Rules comes into force w.e.f. October 9, 2024
