The Rajasthan Registration (Licensing of Document Writers) Rules, 2025 set out the procedures and conditions under which individuals may obtain a licence to write documents for registration purposes in the State of Rajasthan. These rules are made in exercise of powers under the Registration Act, 1908, and they aim to regulate and standardise the practice of document writing in the state.

Key Aspects of the Rules:

Short Title and Commencement:

    • These rules are called the Rajasthan Registration (Licensing of Document Writers) Rules, 2025.
    • They are applicable throughout Rajasthan and came into force on January 24, 2025.

 

Educational Qualification Conditions for Granting Licences:

    • he has attained 21 years of age on the date of application;
    • he is of good character;
    • he is the bonafide resident of the State of Rajasthan;
    • he is a graduate of a University established by law in India;
    • he holds Rajasthan State Certificate in Information Technology (RSCIT) from Rajasthan Knowledge Corporation Limited or higher degree in computer or information technology from the recognised institute or organisation; and
    • he is not employed in any department or undertaking of Government or local body.

 

Number of Licences:

The Licensing Authority will determine the number of licences to be issued for each registration office based on demand and other factors.

 

Procedure for Granting Licences:

  • Applicants must submit applications online and pay a non-refundable fee of ₹500 through e-GRAS challan. The authorities will prepare a merit list based on secondary and senior secondary school examination marks.
  • 50% portion of the vacant licences will be reserved for individuals who already work as stamp vendors.

 

Training and Fees:

  • Once licensed, document writers must undergo training on various legal acts, such as the Registration Act, the Rajasthan Stamp Act, and drafting of deeds.
  • Out of the total vacancies for a particular place 50% of the vacancies shall be filled up from the licenced stamp vendors fulfilling the educational qualifications and other conditions mentioned.

 

Renewal of Licence:

  • Document writers can renew their licences for two years, but they must apply online and pay a renewal fee of ₹2000. There is an exemption for those who register more than 50% of auto deeds in the previous year.

 

Charges for Writing Documents:

    • The rates charged by document writers for writing documents and related services will be fixed by the Inspector General of Registration.
    • No document writer can charge more than the specified rates.

 

Suspension or Cancellation of Licence:

  • Licences can be suspended or cancelled for reasons such as:
    • that the said document writer has become a legal practitioner;
    • that the document writer is a tout;
    • that the document writer has been convicted by a Criminal Court of an offence involving moral turpitude;
    • that the document writer has been found guilty of abetment or participation in any illegal transaction or unfair dealing relating to registration of documents;
    • that the document writer has been found to be inefficient for writing of documents;
    • that the document writer has been guilty of unruly behavior or disobedience of any lawful order issued under these rules or breach of any provision of these rules; and
    • that the document writer has not written the details on the document as provided under rule 11.

 

Record Keeping:

  • Document writers are required to maintain electronic records of the documents they prepare, including details such as the type of document, fees charged, and registration number.

 

These rules regulate the practice of document writing, ensuring that only qualified individuals are allowed to write documents for registration. They help standardise the process and prevent exploitation by setting fees and licensing conditions. This will enhance transparency and accountability in the registration process.
