This advisory means that the Government of India is reinforcing a strict ban on the sale, manufacture, distribution, import, and advertisement of electronic nicotine delivery systems (ENDS) like e-cigarettes, vapes, heat-not-burn devices, e-sheesha, and flavored hookahs.
It highlights the enforcement of:
1. COTPA, 2023 (Cigarettes and Other Tobacco Products Act) – Regulates tobacco products to protect public health, especially young people.
2. PECA, 2019 (Production of Electronic Cigarettes Act) – Specifically bans the production, sale, and advertising of e-cigarettes to prevent nicotine addiction.
The Ministry of Health and Family Welfare has directed all States and Union Territories to ensure that no individual or business sells or promotes these products, especially through online platforms. Authorities must take strict action against violators.
