Registration on FIU-IND FIN Gate Version 2 Portal for Compliance With IFSCA

Relevant Regulations: International Financial Services Centres Authority (Anti Money Laundering, Counter-Terrorist Financing and Know Your Customer) Guidelines, 2022, Prevention of Money Laundering Act, 2002

This circular mandates that all Regulated Entities (REs) under the International Financial Services Centres Authority (IFSCA) must register on the FIU-IND FINGate 2.0 portal to comply with Anti-Money Laundering (AML), Counter-Terrorist Financing (CFT), and Know Your Customer (KYC) guidelines. 

Key Points & Implications: 

  • Mandatory Registration: REs must complete registration before starting operations or within 30 days of commencement if urgent. 
  • Reporting Issues: If any technical or other difficulties arise, REs must inform FIU-IND and IFSCA via email until the issue is resolved. 
  • Updating Business Information: Any new or modified business activities must be updated on the FIU-IND portal within 30 days. 
  • Alternative Compliance: If registration cannot be completed due to uncontrollable reasons, REs must still submit required filings under the Prevention of Money Laundering Act, 2002 via email, stating the reason for not reporting through FINGate 2.0 portal. 
  • Enforcement: Non-compliance will be considered a breach of licensing conditions, potentially leading to penalties or regulatory action.
     

Essentially, this regulation ensures that REs remain compliant with financial crime prevention laws and maintain transparency in their operations.
