General Authorization for Export After Repair (GAER) – Amendment to HBP 2023

Applicable Section/Rule: Paragraph 10.12(D) of the Handbook of Procedures (HBP) 2023

This notification simplifies the export process for repaired high-tech items (SCOMET items) by allowing companies to obtain a one-time authorization (GAER) instead of applying for approval each time they export a repaired item.

  1. Companies can now export repaired items easily: If a company in India imports special equipment (SCOMET items) for repairs, it can now send them back to the original owner or authorized vendors without applying for a fresh export license each time.
  2. Who can receive these repaired items? Only the same foreign entity that originally sent the item, its related companies, or approved vendors/OEMs (Original Equipment Manufacturers).
  3. Faster process with less paperwork: Instead of waiting for approval for each shipment, exporters only need to report their shipments quarterly to DGFT.
  4. Rules and restrictions still apply
    • No changes or modifications to the item are allowed.
    • No exports to sanctioned countries or high-risk entities (such as those under UN Security Council sanctions).
    • Companies must follow strict compliance rules, including internal checks and security certifications (ICP, AEO).

 

Why This Change?

This amendment reduces delays and improves efficiency for companies involved in repairing and maintaining sensitive equipment while ensuring national security controls are still in place.
