Exemption for IT & ITES Establishments under Andhra Pradesh Shops and Establishments Act

Applicable Act: Andhra Pradesh Shops and Establishments Act, 1988

Applicable Sections: Sections 15, 16, 21, 23, 31, and sub-sections (1), (2), (3), and (4) of Section 47

The Government of Andhra Pradesh has granted a five-year exemption to IT/ITES establishments from certain provisions of the Andhra Pradesh Shops and Establishments Act, 1988, subject to specific conditions.

Key Exemptions & Conditions:

1. Working Hours & Overtime:

    • Maximum 48 working hours per week.
    • Overtime wages mandatory for work beyond 48 hours.

2. Weekly Off: Every employee must get one weekly holiday.

3. Women’s Night Shift Employment: Allowed with adequate security and transport facilities. Strict safety protocols for pick-up/drop (e.g., route planning, driver verification, GPS tracking).

4. Identity Cards & Welfare Measures: Employees must be provided ID cards and eligible welfare benefits.

5. Compensatory Holidays: Employees working on notified holidays must get a compensatory holiday with wages.

6. Driver & Transport Safety:

    • Background checks for drivers (own or outsourced).
    • Vehicle tracking via GPS (VAHAN app) and police coordination.
    • CCTV coverage at boarding/alighting points.
    • Security guards recommended for night shift vehicles.

7. Data Privacy: Women employees’ contact details must not be disclosed to unauthorized persons.

8. Digital Compliance: Soft copies of registers should be accepted instead of hard copies. Online submission of employee returns via designated portals.

9. Revocation Clause: Exemption can be withdrawn without prior notice for violations.

Purpose: This exemption aims to ease compliance burdens for IT/ITES firms while ensuring employee welfare and safety, particularly for women working night shifts.
