Boilers Act, 2025 will repeal the century-old Boilers Act, 1923, aiming to overhaul and modernise India’s legal framework for boiler regulation. The new Act introduces a centralised, technically sound, and safety-oriented regime that aligns with current industrial practices.
A Central Boilers Board (CBB) is established with wide powers to regulate all aspects of boiler design, manufacture, inspection, and use. It is also empowered to create sub-committees and delegate authority to expedite decisions. The Act mandates the appointment of a Technical Adviser to support the Centre on technical matters related to boilers.
The Act applies across India to all boiler units and components, including those owned by government bodies. It specifically exempts locomotive boilers, steam-propelled vessels, defence sector boilers, and small medical sterilizers with capacity under 100 litres.
It introduces formal certification for welders and inspection personnel, with institutions recognised by the government authorised to grant such certification. Additionally, only designated competent persons or recognised institutions can inspect and certify boilers.
A separate appeals mechanism is now defined, allowing decisions to be contested before higher authorities including the Chief Inspector and Central Government.
Lastly, the Act prescribes stringent penalties for violations, enhancing safety assurance and compliance enforcement in boiler operations.
This Act will be brought into force through staggered notifications, section-wise, as per government discretion.
