Conditions for Employing Women in Night Shifts in establishments - Haryana

Haryana Labour Department has issued a consolidated notification superseding all earlier ones to regulate employment of women in night shifts across both factories and select commercial establishments. These norms are aimed at ensuring the safety, dignity, and legal protection of women employees working between 07:00 PM and 06:00 AM in the state.

Certain conditions for employing women employees during night shifts with respect to their security, safety and to safeguard the interest of women employees in the State of Haryana and apply for grant of such exemption under Section 28 of the said Act for employing women employees during night shifts in their respective establishments, which are as under:

  1. Must apply at least one month in advance to the Labour Commissioner/Chief Inspector.
  2. Exemption will be Valid for one year, subject to no changes in security, transport, or management details.
  3. Strict adherence to the Sexual Harassment of Women at Workplace Act, 2013 (POSH Act), including Annual Return submission to both District Authority and Labour Commissioner.
  4. Written consent from each woman employee required for night shift work i.e. 08:00 PM to 06:00 AM.
  5. Lighting & Security
    • Adequate lighting in and to all places where the female employees may move out of necessity in the course of such shift.
    • Sufficient security guards during night shift hours.
  6. Secure transport must be provided to the women workers from their residence and back. Security guards (including female security guard), well trained & responsible drivers, proper communication channels with trained drivers, GPS, and CCTV. Women may opt out by giving written consent.
  7. The occupier or manager shall see that the women workers are employed in a batch of not less than four. However, in IT, ITeS sector quorum may be relaxed for any women in senior position (earning more than One lakh per month) when she give consent to work in night.
  8. Ensure availability of a doctor or female nurse during night shifts. Emergency tie-ups with nearby hospitals and ambulance services are allowed. Display key emergency contact numbers (hospital, ambulance, police) prominently.
  1. Wherever the establishment/management provides boarding and lodging arrangements for the women employees, the same shall be kept exclusively for the women under the control of women wardens or supervisors.
  2. The employer shall be at liberty to employ women employees as a whole or in part during night shift, provided, the above directions be complied with.
  3. The above are subject to compliances of ESI and Haryana Labour Welfare Fund, Haryana.
