WBRERA Mandates 3-Month Advance Filing for Project Registration Extension

Applicable Act/Rule: Real Estate (Regulation and Development) Act, 2016; West Bengal Real Estate (Regulation and Development) Rules, 2021

Applicable Section/Rule: Section 37 and Rule 7

West Bengal Real Estate Regulatory Authority (WBRERA) has issued a directive requiring that applications for extension of project registration under the Real Estate (Regulation and Development) Act, 2016 must be submitted at least three months prior to the registration’s expiry date.

“37. Powers of Authority to issue directions: The Authority may, for the purpose of discharging its functions under the provisions of this Act or rules or regulations made thereunder, issue such directions from time to time, to the promoters or allottees or real estate agents, as the case may be, as it may consider necessary and such directions shall be binding on all concerned.”.

“Rule 7. Extension of registration of the project: (1) The registration granted under section 5, may be extended as per section 6, on an application made by the Promoter in FORM – ‘E which shall not be less than 3 months prior to the expiry of the registration granted.”

This instruction is in accordance with section 37 read with rule 7 that the Applications for Extension of Registration of Project shall be made in such time which shall not be less than 3 months prior to the expiry of the Registration granted. All concerned are directed to strictly follow this provision.
