Tamil Nadu Extends 24x7 Operation for Shops and Establishments for Three Years

The Government of Tamil Nadu has extended the permission for all shops and establishments employing 10 or more persons to operate 24×7 on all days for a further period of three years, starting from June 05, 2025. This exemption from the restrictions under Sections 7(1) and 13(1) of the Act is granted under Section 6 of the Tamil Nadu Shops and Establishments Act, 1947 subject to the following conditions that needs to be complied with –

  1. One weekly holiday must be given to every employee on a rotation basis. Details must be displayed in Form S in the establishment.
  2. Employers must display the list of employees on leave each day at a conspicuous place.
  3. All wages, including overtime, must be credited directly to employees’ bank accounts.
  4. Maximum 8 hours/day and 48 hours/week. With overtime restricted to 10.5 hours/day or 57 hours/week.
  5. Employees cannot work on holidays or beyond duty hours without proper overtime records, violations will lead to penal action.
  6. Women shall not be made to work beyond 8:00 PM unless they provide written consent and adequate safety measures are ensured.
  7. Transport must be provided for women working night shifts, and its availability must be clearly displayed at the entrance.
  8. Employers must provide restrooms, washrooms, safety lockers, and other required facilities.
  9. Establishments employing women must form an ICC under the Sexual Harassment of Women at Workplace Act, 2013 and the committee shall be operative.
  10. All above conditions must be followed in addition to the existing provisions under the Tamil Nadu Shops and Establishments Act and Rules.
  11. Non-compliance with statutory or above terms will result in action against the employer or manager under the Act.
