What is Food Safety and Standards (Contaminants, toxins and Residues) Regulations, 2011?
This is a Central Food Regulation drafted by Food Authority in accordance with Section 92 (1) of Food Safety and Standards Act, 2006. The Regulation explain allowable quantity of contaminants, toxins and residues in food articles.
Purpose of the Clause:
Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011
Clause 2.3 – Restriction on the Use of Insecticides in Food Articles
Clause 2.3 of the Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011, provides for restrictions on the use of insecticides in food articles. It prohibits the direct application of insecticides on food, except for fumigants that are registered for such use by the Registration Committee constituted under the Insecticides Act, 1968. Additionally, it prescribes Maximum Residue Limits (MRLs) for various insecticides in specific food items to ensure consumer safety.
Restriction on the use of insecticides:
(1) The expression “insecticide” shall have the meaning assigned to it in the Insecticide Act, 1968 (46 of 1968).
(2) Subject to the provisions of clause (3), no insecticides shall be used directly on articles of food:
Provided that nothing in this regulation shall apply to the fumigants which are registered and recommended for use as such on articles of food by the Registration Committee, constituted under section 5 of the Insecticides Act, 1968 (46 of 1968).
(3) The insecticide specified in column (2) of the table shall not exceed the Maximum Residue Limits (MRL) prescribed in column (4), for the article of food specified in column (3) of the said table, namely:-

Penalty for non-compliance:
Any person who manufactures, stores, sells, distributes, or imports unsafe food for human consumption shall be liable for punishment based on the severity of the outcome: up to six months’ imprisonment and a fine up to ₹1 lakh if no injury occurs; up to one year and ₹3 lakh fine for non-grievous injury; up to six years and ₹5 lakh fine for grievous injury; and a minimum of seven years’ imprisonment (extendable to life) and a fine of at least ₹10 lakh if it results in death.
