Food Safety and Standards (Packaging) Regulations, 2018 - Clause 3(9)

  1. What is Food Safety and Standards (Packaging) Regulations, 2018 ?

This is a Central Food Regulation drafted by Food Authority in accordance with Section 92 (1) of Food Safety and Standards Act, 2006. The Regulation explains guidelines for food packaging.

 

 

Purpose of the Clause

Clause 3(9) – General Provisions for Ink to be Used for Food Packaging

Clause 3(9) of the Food Safety and Standards (Packaging) Regulations, 2018, specifies requirements related to the use of printing inks on food packaging. It prohibits the use of pigments and compounds containing heavy metals such as antimony, arsenic, cadmium, chromium (VI), lead, mercury, and selenium. Further, as per IS 15495:2004 – Printing Ink for Food Packaging – Code of Practice, the use of specific dye colorants known to be bio available and carcinogenic is restricted. These provisions ensure compliance with standards governing ink safety in food contact materials. Pigments and compounds based on antimony, arsenic, cadmium, chromium (VI), lead, mercury and selenium.

Note: In case of pigment and dye-based formulations, those which are known to be bio available and carcinogenic are classified as Category 1 or 2 carcinogens.

 Penalty for non-compliance:

Any person who whether by himself or by any other person on his behalf manufactures for sale or stores or sells or distributes or imports any article of food for human consumption shall be liable to a penalty which may extend to:

– Without injury: Up to ₹1 lakh

– Causing injury: Up to ₹5 lakh + imprisonment up to 6 months

 

– Causing death: Up to ₹10 lakh + imprisonment up to 7 years
