Amendment to Battery Waste Management Rules 2022

Applicable Section/Rule: Section 6, 8, 25 of EPA 1986, Rule 5(4) of Environment Protection Rules, 1986
 
The erstwhile Rule 13 pertaining to Action on violations and imposition of Environmental Compensation in the  Battery Waste Management Rules, 2022 has been amended by notification of  Battery Waste Management (Third Amendment) Rules, 2024  in line with the provisions of the Jan Vishwas (Amendment of Provisions) Act, 2023 for decriminalisation of offences under various Acts.  The Rules  were notified on 3rd December, 2024
 
Accordingly, following changes have been implemented in Battery Waste Management Rules, 2022:
 
i) Existing Rule 13(2) has been omitted
ii) Existing Rule 13(9) has been substituted as follows:
 ” Any person, who fails to comply or contravenes the provisions of these rules shall be liable to a penalty in accordance with the provisions of section 15 of the Act.”
