Revised SOP for Extension of Registration of Real Estate Projects

The Uttar Pradesh Real Estate Regulatory Authority (U.P. RERA) has issued a comprehensive revision to its Standard Operating Procedure (SOP) for the extension of registration of real estate projects. This updated SOP consolidates and supersedes all previous guidelines and circulars issued between 2019 and 2022.  

Its primary objective is to ensure that projects are completed in a time-bound manner while safeguarding the interests of allottees and promoting greater transparency in the real estate sector. 

The manner and procedure of the extension of registration of the project have been laid down under rule 7 of the U.P. Real Estate (Regulation and Development) Rules, 2016. 

If a developer needs more time to finish a project than originally planned, they must apply for an extension. 

  1. Submission of Application for Extension of Registration

As provided under rule 7(1) of U.P. RERA Rules, the promoter shall make an application in the prescribed ‘Form E’, a digital version of which is available on the Promoter Dashboard three months prior to the expiry of the registration granted. 

No fees will be levied only if the application for extension of registration is filed within the stipulated time, i.e. three months prior to the expiry of registration. Therefore, any promoter who fails to submit the application in time would require to deposit the fees for delay as mentioned below:

  1. Details to be Submitted with Application Form

2.1 The application form shall contain the following information: 

(a) Basic Project Details: Basic project details, such as Project Name, Registration No., Project Address, Project Completion Date which shall be auto filled from the registration details. It shall be the responsibility of the promoter to ensure that these details are accurate and up to date on the web page of the project.  

(b) Valid Sanctioned Plan: The promoter shall upload a valid sanctioned plan / building plan/ layout.  

(c) Status of Physical, Financial and Miscellaneous QPRs: The promoter shall ensure that all the QPRs are complete and up to date.  

(d) Status of Annual Report on Statement of Accounts (Form-REG-5): The promoter shall ensure that all annual reports including the latest Annual Report on Statement of Accounts is uploaded.  

(e) Project Bank Account Details: The project bank account details shall be auto filled from the registration details, and it shall be responsibility of the promoter to keep the accounts up to date and accurate.  

(f) Extension Period Availed: The details of previous extension granted, if any, shall be auto filled.  

(g) Current Status of Development: The promoter shall be required to upload authenticated progress of the project detailing the construction and development works undertaken till the date of the application.  

(h) Explanatory Note on Delay: The promoter shall be required to submit an explanatory note, on letter head, clearly indicating the status of development work in the project., pending works in the project and the reasons, in detail, for not completing the construction and development work in the project within the period granted by the Authority, including any previous extension(s) granted.  

(i) Affidavit: The promoter shall be required to submit a notarized affidavit in the prescribed format provided at Annexure 1.  

(j) Proposed Physical and Financial Plan for Completion of Project: The promoter shall be required to upload an excel file of the proposed physical and financial plan for completion of project in the prescribed format provided at Annexure 2.  

(k) Extension Period Sought: The promoter shall be required to fill the date till which the extension of registration is being sought. 

2.2 In case the extension sought is beyond the time period allowed under Section 6 of the Act, the promoter shall be required to submit further information. 

  1. Evaluation of Extension Application

3.1 For Extension Within the Limits of Section 6 

    • Initial Evaluation: The Technical Division reviews the application using a checklist (Annexure 5) to note any defects. 
    • Response Requirement: The promoter is issued a notice to address any defects and must respond within 7 days. 
    • Review Process: A Committee comprising Technical, Legal, and Financial experts reviews the promoter’s responses. The Technical Division may call the promoter for further clarifications if needed.

3.2 For Extensions Beyond Limits of Section 6: 

    • Detailed Evaluation: The Technical Division reviews the application and prepares a checklist (Annexure 5) while also conducting a physical inspection of the project. 
    • Joint Committee Assessment: A joint committee (Technical, Legal, and Finance Divisions) assesses the project on four factors: 
    • Legal Viability: Ensuring compliance with legal and regulatory requirements. 
    • Economic Viability: Evaluating the financial health of the project. 
    • Operational Viability: Determining the promoter’s capacity to complete the project. 
    • Project Oversight by AoA: Assessing the effectiveness of the Association of Allottees in monitoring the project. 
    • Response and Clarification: The promoter receives a notice to address any objections within 7 days. The Technical Division reviews the response and may arrange a personal hearing involving the promoter, AoA, and lenders to resolve any remaining concerns.

  1. Disposal of Application 

4.1 Application for Extension Within the Limits of Section 6 

    • Certificate Issuance: If there are no objections or all objections are resolved by the promoter, the Technical Division, with the Secretary’s approval, issues the certificate of extension (Form-F). 
    • Pending Objections: If objections remain, the Secretary forwards the matter to the Authority, which reviews it after hearing the promoter, and then decides accordingly. 
    • Rejection: In case of rejection, the promoter is notified using Form D.

4.2 Application for Extension Beyond Section 6 Limits: 

    • Submission for Review: The Secretary submits the application along with a report covering legal, economic, and operational viability and the AoA’s consent to the Authority. 
    • Authority Review: The Authority reviews the report, holds a hearing with the promoter and the AoA, and may impose additional conditions. 
    • Certificate Issuance & Rejection: Upon approval, the certificate (Form-F) is issued. If rejected, the promoter receives a rejection notification via Form D.

4.3 Re-application on rejection of application: 

  • Opportunity to Reapply: If the application is rejected, the promoter may reapply after addressing the noted deficiencies and paying the requisite fees.

  1. Activities after Extension of Registration

5.1 By Promoter 

    • Reset Targets: Promoters must update their physical and financial quarterly targets and submit revised certificates from architects, engineers, and chartered accountants within 7 business days. 
    • Quarterly Reporting: They are required to submit a detailed Physical and Financial Plan for completing the remaining work along with Quarterly Progress Reports (QPRs) in the prescribed format every quarter. 
    • Mandatory Meetings: For extensions granted beyond the limits of Section 6, promoters, along with representatives of the Association of Allottees (AoA), must attend a quarterly meeting with the Authority or its authorized officer to update on project progress. 

5.2 By Authority: 

  • Project Listing: 
    • Projects extended within the limits of Section 6 will have the extended period displayed alongside the project name. 
    • Projects extended beyond Section 6 will be listed under a special category (“Projects Extended Beyond Scope of Section 6”) on the U.P. RERA Web Portal. 
  • Monitoring & Review: The Technical Division or other authorized officers will review QPRs against the submitted Physical and Financial Plan every quarter. They will organize quarterly meetings with the promoter and AoA representatives for projects extended beyond Section 6 to assess progress. 
  • Enforcement: If a promoter fails to make adequate progress for two consecutive quarters, the Secretary will refer the matter to the Authority for further review and appropriate action.
