Fire Prevention & Safety Measures Under Telangana Fire Service Act, 1999

Background

Fire safety in buildings is a critical public concern, especially with the increasing density of urban construction and the growing number of high-rise and commercial structures. Recognizing this need, the Telangana Fire Service Act, 1999 was enacted to ensure robust fire prevention and protection mechanisms are in place across the state.

The Act empowers the Fire Services Department to enforce fire safety regulations, issue No Objection Certificates (NOCs) before construction approvals, and monitor compliance with fire safety measures throughout a building’s construction. The provisions of the Act are applicable across Telangana and apply to a wide range of buildings—commercial, residential, public congregational spaces like schools and function halls, and others meeting specific thresholds of height or area.

Applicability

The Act primarily governs:

    • Buildings over 15 metres in height for commercial/business use.
    • Buildings 18 metres or above for residential use.
    • Public congregation buildings such as schools, cinemas, religious places, and function halls, if the plot area exceeds 500 sq. meters or the building is 6 metres or above in height.

Anyone proposing to construct such a building must first obtain a No Objection Certificate (NOC) from the Director General of Fire Services or an authorized officer before submitting the building plan to the local authority. The NOC ensures that the building design complies with fire prevention and life safety norms under the National Building Code of India and applicable urban planning regulations.

Required Compliances under the Act

 

  1. No Objection Certificate (NOC) Prior to Building Plan Approval [Section 13]
    • Builders must apply for an NOC before submitting their plans to local municipal or urban development authorities.
    • The Fire Services authority must inspect and issue or reject the NOC within 60 days, citing reasons for rejections, if any.
    • No authority is allowed to approve construction plans unless the NOC is granted.
  1. Installation and Maintenance of Fire Safety Measures

Under Section 19, the owner or occupier of a building is responsible for:

    • Installing fire safety measures as per building bye-laws.
    • Keeping equipment in good working condition at all times.
    • Implementing additional safety provisions if the building was constructed or under construction before the Act came into effect.
    • Tampering with or damaging fire prevention and fire safety equipment is strictly prohibited under the Act.

Uploading of Fire Safety Audit Certificate in High Rise Building/Non High Rise Buildings [Section 19]

    • Residential buildings above 30 meters and below 45 metres height, business, mercantile, educational, industrial buildings above 15 metres height and below 30 metres height, hotels up to 30 metres height shall upload a Fire Safety Audit Certificate obtained from 3rd party Safety Auditor/ Consultant in the website of Telangana Fire Service Department, once in a year by January for compliance with Fire Prevention and Life Safety Measures.
    • Residential buildings 45 meters height, Malls & Multiplexes, Hospital buildings above 15 meters, hotels above 30 meters height, business and mercantile buildings above 30 meters height shall upload a Fire Safety Audit Certificate obtained from 3rd party Safety Auditor/ Consultant in the website of Telangana Fire Service Department, every six months by January/July for compliance with Fire Prevention and Life Safety Measures.

  1. Fire Safety Inspection and Notices
    • After inspecting a building, the authorized officer may issue a notice under Section 21 highlighting deficiencies in fire safety arrangements.
    • The notice will instruct the owner/occupier to rectify the lapses within a specified timeframe.
    • Failure to comply can lead to enforcement actions by the Fire Department under Section 22.

Penalties for Non-Compliance

The Telangana Fire Service Act lays down stringent penalties to enforce compliance:

  • Under Section 22: In case of failure to comply with a safety notice issued under Section 21, the authorised officer may take necessary actions to enforce compliance, potentially including closure or demolition of unsafe portions.
  • Under Section 28: Any person who wilfully and without any reasonable cause obstructs or interferes with any member of the service who is engaged in fire-fighting operations shall be punishable with imprisonment for a term which may extend to three months or with fine which may extend to five hundred rupees or with both.
  • Under Section 31: Willful violation of any provision of the Act or failure to comply with lawful requisitions can attract:
    • Imprisonment up to 3 months or
    • Fine up to ₹25,000 or
    • With both, and

Where the offence is a continuing one, with a further fine which may extend to three thousand rupees for every day during which such offence continues after the conviction for the first such offence

In the absence of special and adequate reasons to the contrary to be mentioned in the judgment of the Court, such punishment shall not be less than one month and such fine shall not be less than five thousand rupees or such daily fine shall not be less than one hundred rupees per day for a continuing offence.
