Relaxation in Charges for Pending Extension Applications under Bihar RERA

Applicable Section/Rule – Rule 6 of Bihar Real Estate (Regulation and Development) Rules, 2017; Regulation 10 & 11 of Bihar RERA (General) Regulations, 2024

To ease the process of doing business and ensure smoother compliance for real estate promoters, Bihar Real Estate Regulatory Authority (Bihar RERA) has taken a series of decisions related to pending and rejected applications for extension of project registrations, especially those impacted by the implementation of the Bihar RERA (General) Regulations, 2024.

  • Exemption from Charges for Older Applications:
    Applications for extension filed before August 01, 2024 (i.e. prior to the new Regulations) and pending or rejected shall not attract additional or late charges under Regulation 10 and 11.
  • Reconsideration of Rejected Cases:
    Cases previously rejected solely due to non-payment of additional or late charges may be reconsidered if the promoter submits a request letter.
  • Withdrawal of Previous Circular:
    The earlier notice dated July 28, 2021, that mandated an additional fee of ₹1 lakh from August 01, 2021, is withdrawn. However, 50% of the original registration fee as per RERA Rules, 2017 remains applicable for all extension applications.
  • Late Filing Under Amnesty Scheme:
    A special amnesty scheme is active for promoters who failed to apply for extension within the stipulated three months before registration expiry. Such late applications can be accepted if all required documents, including a duly sanctioned map, are provided.
  • Mandatory Financial Disclosure:
    Promoters must declare that their net worth is at least 10% of the estimated development cost. They must file an affidavit (Annexure I) detailing immovable assets and liabilities of both the entity and its key individuals (e.g., directors, partners, proprietor).
