Release of Advertisement – TNRERA Directions for Compliance

Applicable Act/Rule – Real Estate (Regulation and Development) Act, 2016

In the interest of homebuyers (allottees) and the real estate sector, the Tamil Nadu Real Estate Regulatory Authority (TNRERA) has issued revised directions under Section 37 of the Real Estate (Regulation and Development) Act, 2016 to promoters of real estate projects regarding the release of advertisements in print, electronic, social media, and other platforms such as outdoor advertisements. These directions supersede the earlier proceedings issued on 01.07.2025 and have also been incorporated into the Tamil Nadu Real Estate Regulatory Authority (General) Regulations, 2018 by amending Regulation 6.

Key Provisions:

  1. Newspapers & Magazines:
    • Advertisements must display the TNRERA registration number with QR code (Form-C) and the Authority’s website address, positioned at the top or bottom (left or right corner).
    • Font size: Minimum 12 points for ads of quarter page or larger; minimum 8 points for smaller ads.
    • For multi-page ads, details must be repeated on every page.
  2. Classified Advertisements:
    • Exempt from QR code but must mention RERA registration number.
  3. Brochures & Leaflets:
    • Must display RERA registration number with QR code and Authority’s website address in legible, readable font.
  4. Outdoor Publicity:
    • Boards, hoardings, bus advertisements, and other outdoor formats must include RERA registration number with QR code and website address in a readable format, positioned at top or bottom (left or right corner).
  5. Electronic Media:
    • TV/Radio: Must specify whether the project is “RERA Registered”.
    • Other Electronic Media: Must clearly mention RERA registration number, Authority’s website address, promoter’s name, and contact address.
  6. Social Media:
    • All promotional posts must mention RERA registration number and provide a link to the TNRERA website.
  7. Online Property Portals:
    • Cannot advertise any real estate project without TNRERA registration number with QR code (Form-C) and website address.
  8. General Provisions:
    • Promoters must clearly state terms and conditions in ads instead of generic disclaimers.
    • Must provide postal address in addition to site address.
    • Unregistered or exempt projects must be clearly marked as “Project is exempted from RERA registration”.
    • Ads must include promoter’s name, office address, contact details, and exact project location.
    • Amenities mentioned must match the Agreement/Brochure.
    • Where QR code is not available, promoters must generate it from Form-C/Form-F.

Compliance & Penalties:

  • Non-compliance by promoters will invite action under Sections 61 and 63 of the RERA Act, 2016.
  • Media houses must ensure compliance; violations will be reported to concerned regulatory bodies, and penal action will be taken against errant media houses.

 

Amendment to Regulation 8(3):

  • All advertisements across media must bear project registration details as prescribed under Regulation 6 or indicate exemption under Section 3(2).
