Background
The Gujarat Boilers Rules, 1966 have been framed under the Boilers Act, 1923 to regulate the installation, registration, operation, inspection, and maintenance of boilers in the state of Gujarat. Paper slip of the proper size bearing the registry number allotted for a boiler will be supplied by the Chief Inspector. The slip should be pasted on the part of the boiler pointed out by the inspector and the device traced through with a cutting tool. The engraving should then be completed by the removal to the prescribed depth of the metal between the traced lines. Penalty & Punishment
Reg 392(7) of Boiler’s Reg: The repairer if found indulging in violating the provisions of the Act/ Regulation knowingly or unknowingly, the Firm shall be blacklisted and renewal shall not be done in that case.
The Central Boilers Board or the CG or the State Govt have powers to make regulations under Section 28, 28A or 29 for prescribed matters and Sec 30 provides —Any regulation or rule made under section 28 or section 29 [may direct that a person contravening such regulation or rule shall be [liable to penalty, in the case of a first
contravention, with penalty] which may extend to [one thousand rupees], and in the case of any [subsequent contravention, with penalty] which may extend to [one lakh rupees]].
Sec 23(c ) -Any owner of a boiler who fails to cause the register number allotted to the boiler under this Act to be permanently marked on the boiler as required under sub-section (6) of section 7 shall be liable to penalty which may extend to one lakh rupees, and in the case of a continuing contravention or failure, with an additional penalty which may extend to one thousand rupees for every day during which such contravention or failure continues
