Gujarat Boilers Rules 1966

Background

The Gujarat Boilers Rules, 1966 have been framed under the Boilers Act, 1923 to regulate the installation, registration, operation, inspection, and maintenance of boilers in the state of Gujarat. These rules provide detailed procedures and requirements relating to safety, working conditions, repairs, transfer, inspection, and certification of boilers. The primary objective is to ensure the safe operation of boilers, thereby protecting workers, industrial premises, and surrounding communities from potential hazards due to boiler failures or unsafe practices.

Applicability

The Gujarat Boilers Rules, 1966 are applicable to:

  • All factories, establishments, and industries within the State of Gujarat that operate boilers.
  • Owners of boilers who install, transfer, or repair boilers in the state.

Compliance requirements under the Rules in accordance with the Act

  • Display of Instructions to owners in factory in Gujarat (Rule 8, Gujarat Boilers Rules 1966)
    Instructions issued by the Chief Inspector (Form C) with regards to maintenance, working and cleaning of boilers should be hung up by owners in each Boiler House.   • Procedure on transfer of boiler into the State of Gujarat (Rule 23, Gujarat Boilers Rules 1966)
    Whenever a boiler is transferred from another State into the State of Gujarat the owner shall, under Section 6 (b) apply to the Chief Inspector for the registration of the transfer; the boiler cannot be used until registration has been effected. The Chief Inspector shall then obtain from the State from which the boiler was transferred the Registration Book and Memorandum of Inspection Book of the boiler. No fee shall be charged for recording transfers. On transfer of boiler from a State into State of Gujarat, owner to apply for the registration of the transfer. The boiler cannot be used until registration has been effected.
  • Repairs to boilers in factory in Gujarat (Rule 30, Gujarat Boilers Rules 1966)
    Under Section 12 of the Act the sanction of the Chief Inspector to all repairs proposed for boilers must be obtained before hand. A few water tubes or smoke tubes however, may in an emergency be renewed pending the sanction of the Chief Inspector but all such cases must be reported immediately to the Chief Inspector who may, if he deems fit, notify his sanction to the owner without verification of the renewals by an inspector. Extensive repairs such as renewal of furnaces, end plates, parts of shell, fire boxes, girder, etc., should be supervised so far as his other duties permit, by the inspector, and at such times when fire boxes and smoke tubes of locomotive type boilers are withdrawn, advantage of the opportunity should be taken to inspect the internal parts otherwise inaccessible to close inspection. Sanction of Chief Inspector to be obtained for all the repairs to boiler before hand. Few water tubes/smoke tubes may in emergency be repaired pending sanction but all such cases to be reported to him who may notify sanction. Extensive repairs to be supervised by the Inspector.
  • Engraving of Registry Number on boiler in factory in Gujarat (Rule 33, Gujarat Boilers Rules 1966)

Paper slip of the proper size bearing the registry number allotted for a boiler will be supplied by the Chief Inspector. The slip should be pasted on the part of the boiler pointed out by the inspector and the device traced through with a cutting tool. The engraving should then be completed by the removal to the prescribed depth of the metal between the traced lines.   • Certificate of inspection (Rule 35, Gujarat Boilers Rules 1966)
    Certificate of inspection to be issued to the owner within 48 hours of completion of inspection.
  • Certificate of proficiency as Engineers of the First or Second class (Rule 160, Gujarat Boilers Rules 1966)

Certificate of proficiency is required by Engineers to be in charge of steam engines and boilers as per Form D of Boilers Rules 1966.

Penalty & Punishment

Reg 392(7) of Boiler’s Reg: The repairer if found indulging in violating the provisions of the Act/ Regulation knowingly or unknowingly, the Firm shall be blacklisted and renewal shall not be done in that case.

The Central Boilers Board or the CG or the State Govt have powers to make regulations under Section 28, 28A or 29 for prescribed matters and Sec 30 provides —Any regulation or rule made under section 28 or section 29 [may direct that a person contravening such regulation or rule shall be [liable to penalty, in the case of a first
contravention, with penalty] which may extend to [one thousand rupees], and in the case of any [subsequent contravention, with penalty] which may extend to [one lakh rupees]].

Sec 23(c ) -Any owner of a boiler who fails to cause the register number allotted to the boiler under this Act to be permanently marked on the boiler as required under sub-section (6) of section 7 shall be liable to penalty which may extend to one lakh rupees, and in the case of a continuing contravention or failure, with an additional penalty which may extend to one thousand rupees for every day during which such contravention or failure continues
