The Rajasthan Boiler Rules, 1954

Background

The Rajasthan Boiler Rules, 1954 were framed under the Boilers Act, 1923, to regulate the use, registration, inspection, maintenance, and safety of boilers within the State of Rajasthan. The rules lay down detailed procedures regarding certification, inspection, transfer, repair, record-keeping, and responsibilities of owners and competent persons. These provisions ensure operational safety, prevent accidents, and standardize compliance with statutory requirements. Over time, amendments such as the introduction of self-certification schemes and competency regulations have modernized the compliance framework while retaining focus on safety and accountability.

Applicability

The Rajasthan Boiler Rules, 1954 apply to:

  • All boilers used in factories, establishments, and industries within Rajasthan.
  • Boiler owners and occupiers who are required to register, maintain, and operate boilers in accordance with the Act and Rules.

Compliance requirement under the Rules

  • Submission of records by competent person (S.O. 172 date 14 Aug, 2014 by Factories & Boilers Inspection Department)

The Competent Person shall submit records of inspection carried out by them to the Chief Inspector, Inspector and to the owner of the boiler within 30 days of carrying out the inspection and preferably on their web-site.

  • Report of daily chemical analysis to competent person (S.O. 172 date 14 Aug, 2014 by Factories & Boilers Inspection Department)

Report of daily chemical analysis for feed water and blow down water i.e. boiler water should be submitted monthly to the Competent Person for scrutiny and to the Chief Inspector of Factories & Boilers, Rajasthan for information.

  • Working pressure of the boiler in factory in Rajasthan (S.O. 172 date 14 Aug, 2014 by Factories & Boilers Inspection Department)

Working pressure of the boiler shall not exceed to that as specified in the last certificate issued as per the provisions of the said Act, Rules and Regulations framed thereunder.

  • Display of instructions to owners of factory using boiler in Rajasthan (Rule 7)
    Instructions issued by the Chief Inspector (Form C) with regards to maintenance, working and cleaning of boilers should be hung up by owners in each Boiler House.
  • Procedure on transfer of boiler into the State of Rajasthan (Rule 22)
    Whenever a boiler is transferred from another State into the State of Rajasthan the owner shall, under Section 6 (b) apply to the Chief Inspector for the registration of the transfer; the boiler cannot be used until registration has been effected. The Chief Inspector shall then obtain from the State from which the boiler was transferred the Registration Book and Memorandum of Inspection Book of the boiler. No fee shall be charged for recording transfers. On transfer of boiler from a State into State of Rajasthan, owner to apply for the registration of the transfer. The boiler cannot be used until registration has been effected.
  • Repairs to boilers in factory in Rajasthan (Rule 29)
    Under Section 12 of the Act the sanction of the Chief Inspector to all repairs proposed for boilers must be obtained before hand. A few water tubes or smoke tubes however, may in an emergency be renewed pending the sanction of the Chief Inspector but all such cases must be reported immediately to the Chief Inspector who may, if he deems fit, notify his sanction to the owner without verification of the renewals by an inspector. Extensive repairs such as renewal of furnaces, end plates, parts of shell, fire boxes, girder, etc., should be supervised so far as his other duties permit, by the inspector, and at such times when fire boxes and smoke tubes of locomotive type boilers are withdrawn, advantage of the opportunity should be taken to inspect the internal parts otherwise inaccessible to close inspection.
  • Engraving of Registry Number on boiler in factory in Rajasthan (Rule 32)
    Paper slip of the proper size bearing the registry number allotted for a boiler will be supplied by the Chief Inspector. The slip should be pasted on the part of the boiler pointed out by the inspector and the device traced through with a cutting tool. The engraving should then be completed by the removal to the prescribed depth of the metal between the traced lines.
  • Certificate of inspection

Certificate of inspection to be issued to the owner within 48 hours of completion of inspection in cases in which the Competent Person is empowered to issue a certificate under section 8 without further reference and 15 days in any other case.

  • Application for Self Certification Scheme for Boilers (The Rajasthan Boilers Rules, 1954 – Notification issued by Rajasthan State Govt)

This Scheme is optional and any owner can opt for this scheme. Owner of boiler covered under the scheme shall apply for self certification for boilers to the Chief Inspector. Once opted, the scheme is valid for 5 years. After expiry of 5 years, owner may decide to continue under the scheme or otherwise and decision w.r.t. same to be communicated in writing to the Chief Inspector.

  • Filing of annual self certification for boiler in lieu of Inspection Report by Inspector (The Rajasthan Boilers Rules, 1954 – Notification issued by Rajasthan State Govt)
    After being enrolled for self certification scheme for boilers, concerned owner shall file Annual Self Certification for boiler every year within 15 days of expiry of the certificate of boiler for 5 years. After being enrolled for self certification scheme for boilers, concerned owner shall file Annual Self Certification for boiler every year within 15 days of expiry of the certificate of boiler for 5 years.

Penalty & Punishment

1) Boiler’s Act,1923:The Central Boilers Board or the CG or the State Govt have powers to make regulations under Section 28, 28A or 29 for prescribed matters and Sec 30 provides —Any regulation or rule made under section 28 or section 29 may direct that a person contravening such regulation or rule shall be liable to penalty, in the case of a first contravention, with penalty which may extend to one thousand rupees, and in the case of any subsequent contravention, with penalty which may extend to one lakh rupees.

2)Rajasthan Boiler Rules, 195: A person who does or commits to do any act prohibited or prescribed under the rules shall be punishable with a fine, which may extent to one hundred rupees.(Rule 68)

1) Sec 23 of Boiler’s Act 1923 – Any owner of a boiler who—

(a)in any case in which a certificate or provisional order is required for the use of the boiler under this Act, uses the boiler either without any such certificate or order being in force or at a higher pressure than that allowed thereby

(b) uses or permits to be used a boiler which has been transferred from one State to another without such transfer having been reported as required under clause (b) of section 6; shall be liable to penalty which may extend to one lakh rupees, and in the case of a continuing contravention or failure, with an additional penalty which may extend to one thousand rupees for every day during which such contravention or failure continues.
