Background
The Uttar Pradesh Lifts and Escalators Act, 2024 was enacted to regulate the installation, maintenance, and safe operation of lifts and escalators across the state. It was introduced in response to rising accidents and safety concerns, especially in high-rise areas. The Act mandates registration, annual maintenance contracts, safety devices, insurance, and accident reporting, with the objective of ensuring passenger safety and accountability of owners and service providers.
Applicability
The Uttar Pradesh Lifts and Escalators Act, 2024 applies to all owners of buildings in Uttar Pradesh where lifts or escalators are installed or proposed to be installed. It covers residential, commercial,
industrial, and public buildings, requiring mandatory registration, maintenance contracts, and compliance with prescribed safety standards.
Compliance Requirement Under the Act:
Every owner of the lift or escalator is required to take the necessary registration within the time period prescribed in respective State’s Act.
1) Applications for “Private Premise” and “Public Premise” shall be registered separately
2) After registration, the owner shall get his lift or escalator erected by a person authorized under section 11
3) Every registration shall be valid for a period of whole life of lift/escalator
4) In case any alteration or addition is made to an existing lift or escalator, fresh registration shall be mandatory
5) In case any lift or escalator is shifted to some other premise, fresh registration shall be mandatory
6) A lift or escalator installed in the premises shall be uninstalled by the owner of the lift or escalator on expiry of life span of the lift or escalator specified by the manufacturer.
7) “Private Premise” means someone’s own residential house having 1 basement floor, ground floor and two floors above
ground floor used by his own self or by his family members
8) “Public Premise” means all premises which are not “Private Premise”
The owner who has registered to install a lift or escalator under section 3 shall intimate the completion of commissioning, before use of lift or escalator, to such officers as the Government may authorize in this behalf on a prescribed format for the purpose lift or escalator along with a fee as may be prescribed.
3.Maintenance of Lift or Escalator in Uttar Pradesh (Section 5)
Owner of a Lift/Escalator to ensure:
a) Lift/escalator in his premise is maintained on a regular periodic interval. He should take a comprehensive AMC from OEM/authorised service provider
b) Submit every year copy of AMC/other arrangement made for maintenance of Lift/escalator to prescribed officers
4.Installation of automatic rescue device in Uttar Pradesh (Section 6)
The owner shall ensure the provision of installation of an automatic rescue device in the lift to rescue the travelling passengers trapped inside, in case of any breakdown.
5.Insurance for accidents or mishaps in Lift/Escalator in Uttar Pradesh (Section 7)
In Public Premises, owner shall take insurance mandatorily to cater adequately to any accidents/mishaps during operations of lift or escalator to cover risk of passengers using such lift or escalator and amount payable to the deceased or injured must be commensurate to norms prescribed by Government.
6.Compliance of various codes for building, electrical-mechanical installation and lift or escalator in Uttar Pradesh (Section 8)
The relevant code of practice with respect to building in which lift or escalator is to be installed, the lift or escalator itself, any other electrical or mechanical apparatus and installations and any other code of relevance shall be adhered to.
7.Report of accidents in a lift or escalator (Section 12(1))
In case of accident during operation of a lift/escalator resulting into loss of/injury to human or animal life; the owner or any other person duly authorized to inform District Magistrate and Police Station in-charge having jurisdiction or other officers as Government may authorize in this behalf without any delay but not later than 24 hours of occurrence of accident.
8.Lift/escalator not to be interfered in case of accident in Uttar Pradesh (Section 12(2))
In case of accident, lift/escalator installation shall not be interfered except for rescue operation & working of lift/escalator shall not be resumed except with prior written permission of District Magistrate who shall give permission after taking technical report from juris. Electrical Inspector.
9.Logbook of accidental history in Public Premises in Uttar Pradesh (Section 12(3))
A separate logbook of accidental history shall be maintained and displayed near lift or escalator installed in Public Premise and the same shall, be produced when asked by any such officers as the Government may authorize in this behalf.
Penalties & Punishments
As per Section 15, a late fee shall be charged to the owner in case he violates any timeline prescribed under this act or rules made thereunder as prescribed.
