24x7 Operations for Shops in Chandigarh & NSA Powers Delegated

Notification/Circular No.: No. 12/2/149-HII(2)2025/12994 & No. LD-2025/11306 dated August 14 & August 19, 2025         

Applicable Act/Rule – Punjab Shops and Commercial Establishment Act, 1958 (as applicable to UT of Chandigarh); National Security Act, 1980

The Chandigarh Administration has issued two major updates:

  1. Round-the-Clock Operations for Shops & Establishments
    • All shops and commercial establishments are now allowed to operate 24×7, 365 days a year.
    • The exemption is subject to strict conditions safeguarding employees, including:
      • Working Hours: Maximum 9 hours per day / 48 hours per week with two rest breaks; overtime permitted up to 50 hours per quarter at double wages.
      • Rest Days & Holidays: Weekly paid holiday with roster display, compulsory national/festival holidays.
      • Wages & Records: Payment via bank transfer, maintenance of attendance and wage records.
      • Safety Measures: Installation of CCTV with 15-day backup, emergency alarms, and adequate lighting.
    • Night Shift Conditions for Women Employees:
      • Women can work after 8:00 p.m. only with written consent.
      • Employers must provide safe and secure transport with escorts and GPS tracking.
      • Each night shift must have at least five women employees on duty.
      • Adequate restrooms, washrooms, lockers, and break facilities must be provided.
      • Compliance with the POSH Act, 2013 is mandatory.
      • Maternity benefits and protection of dignity must be ensured.
      • Annual self-defence training workshops must be organised for women employees.
    • Non-compliance with these safeguards may lead to withdrawal of the exemption.
  2. Delegation of NSA Powers
    • The District Magistrate, Chandigarh has been authorised to issue detention orders under Section 3(3) of the National Security Act, 1980.
    • This delegation, valid for three months from August 26, 2025, empowers the DM to act against activities threatening national security, public order, or essential services/supplies.
