Deletion of Mandatory NOC Requirement from Two-Third Allottees

Notification/Circular No. 38/RERA/2025/2539 dated November 03, 2025

Applicable Act/Rule – Real Estate (Regulation and Development) Act, 2016

CG RERA had earlier required promoters to submit a No-Objection Certificate from two-third allottees for second extensions or extensions exceeding one year. This condition was part of Circular No. 130 dated September 23, 2025.

The mandatory requirement to submit an NOC from two-third allottees—previously applicable for second extensions and extensions beyond one year—has been removed. Instead, the Authority will decide on a case-by-case basis whether an NOC is required. The Authority may impose this NOC requirement, or any additional conditions, while examining project extension requests.
