Guidelines for Prevention & Control of Pollution from Hotels/Marriage Gardens/Restaurants in Rajasthan

Background               

The Government of Rajasthan issued the Guidelines for Prevention & Control of Pollution from Hotels, Marriage Gardens, and Restaurants with the objective of regulating environmental impacts caused by these establishments. Due to rapid urbanization, large-scale water consumption, waste generation, and noise from such units, there was a growing concern about sustainable operations. The guidelines provide a structured framework to ensure that hotels, marriage gardens, banquet halls, and restaurants comply with environmental standards, thereby reducing water pollution, controlling noise levels, managing waste, and protecting groundwater resources.

Applicability

These guidelines apply to:

  • Hotels of varying sizes and star categories operating within Rajasthan.
  • Marriage Gardens and Banquet Halls having borewell with large areas and visitor capacity.
  • Restaurants and eating establishments with significant seating capacity.

Compliance requirement under the Guidelines

  1. NOC / Registration Certificate for usage of Agriculture/ Residential Land (Clause 2(b))
    NOC / Registration Certificate is required to be taken from Local Authority for usage of Agriculture/ Residential Land for Marriage Garden. NOC / Registration Certificate is required to be taken from Local Authority for usage of Agriculture/ Residential Land for Marriage Garden.
  1. STP for Orange Category Premises with daily sewerage 10 KL or more in Rajasthan (Clause 5(1)(d))
  2. Hotels / Marriage Gardens / Restaurants and Banquet Halls in Orange Category with daily sewerage of 10 KL or more should have a sewerage treatment plant. Orange Category:

a. 21 to 99 rooms’ hotel

b. 3 star or lower hotel

c. Restaurant with more than 25 seats

d. Marriage Garden or Banquet Hall with more than 2500 sqmt area

     4.Water Meter & Log Book to record Water Extraction in Rajasthan (Clause 5(4))

All units having borewell should have a dedicated Water Meter to monitor the water extraction & Log Book should be maintained to record Water Extraction.   1. Rain Water Harvesting Structure (Clause 5(4))

Units doing ground water extraction should have a Rain Water Harvesting Structure in the premises. Units doing water extraction from ground water should have a Rain Water Harvesting Structure in the premises.

  1. Plantation in Marriage Garden in Rajasthan (Clause 5(10))

Plantation of trees should be ensured around the marriage garden. Plantation of trees should be ensured around the marriage garden.

Penalty & Punishment

Non-compliance with these guidelines shall attract action under section 15 of the Environment (Protection) Act, 1986, including imprisonment up to five years or fine up to ₹1,00,000, or both. In case of continuing contravention, an additional fine may be imposed, and if the failure continues beyond one year, imprisonment may extend up to seven years.
