Delhi Shops and Establishments (Amendment) Act, 2026

The Delhi Legislative Assembly passed the Delhi Shops and Establishments (Amendment) Act, 2026 on January 09, 2026, which received the assent of the President of India on February 23, 2026. The Act amends the Delhi Shops and Establishments Act, 1954 in its application to the National Capital Territory of Delhi and has been published in the Delhi Gazette for public information.

  1. Amendment to Section 1
    After sub-section (4), the following sub-section shall be inserted:

“(5) The Act shall be applicable to shops and establishments employing twenty or more employees.”

  1. Amendment to Section 2
    In sub-section (2), for the words “twelth year”, the words “fourteenth year” shall be substituted.
  2. Amendment to Section 8
  • For the words “nine hours”, the words “ten hours inclusive of rest interval and lunch break” shall be substituted.
  • In the first proviso, for the words “but not exceeding 54 hours in any week subject to the conditions that the aggregate hours so worked shall not exceed 150 hours in a year”, the words “but not exceeding sixty hours in any week subject to the conditions that the aggregate hours so worked shall not exceed one hundred forty four hours in a quarter” shall be substituted.
  1. Amendment to Section 10
    For the words “five hours”, the words “six hours” shall be substituted.
  2. Amendment to Section 11
    For the words “ten and a half hours in any commercial establishment or for more than twelve hours in any shop”, the words “twelve hours” shall be substituted.
  3. Substitution of Section 14
    Section 14 shall be substituted with provisions stating that:
  • No young person shall be required or permitted to work in any establishment during night.
  • Women may be employed in all establishments and may work with their consent between 9:00 PM to 7:00 AM during summer and 8:00 PM to 8:00 AM during winter, subject to conditions including written consent, CCTV surveillance, security and transport facilities, prohibition on employment during six weeks after confinement or miscarriage, minimum two women employees during the period, compliance with the Prevention of Sexual Harassment of Women at Workplace Act, 2013, and other conditions notified by the Government.

To come into force on such date as notified by the Government of National Capital Territory of Delhi in the Official Gazette.
