The Food Safety and Standards (Labelling and Display) Regulations, 2020 prescribe requirements for labelling and display of packaged food products. Draft amendment regulations were issued on November 30, 2022, inviting objections and suggestions from stakeholders, and copies were made available on December 05, 2022. After considering stakeholder inputs, the Authority has finalized amendments to update labelling provisions, including non-retail packaging, declarations, and exemptions.

  1. Regulation 5 (Labelling Requirements):
    “Provided further that per serve percentage (%) contribution to Recommended dietary allowances (RDA) and number of servings per pack may not be given for Infant Nutrition products as defined under the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020.”

Substitution:
“(i) Raw agricultural minimally processed products such as wheat, rice, cereals, pulses, fruits and vegetables and/or products that comprise a single ingredient.
Explanation. – Minimally processed foods are the ones that are slightly altered for the main purpose of preservation but which do not substantially change the nutritional content of the food, which may involve cleaning and removing inedible or unwanted parts, grinding, refrigeration, pasteurization, fermentation, freezing, and vacuum-packaging.”

Omission:
Sub-clause (ii) omitted.

Substitution:
“(xiii) Health supplements, Nutraceuticals and Foods for Special Dietary Uses (FSDU) in tablet, pills and capsule format, with respect to macronutrients, when sources of energy are insignificant.”

  1. Regulation 8 (Logo Requirements):
    “The logos notified under Food Safety and Standards Regulations may not be given where the surface area of the package is not more than 100 square centimetres, but this information shall be given on the multi-unit packages.”
  2. Regulation 10 (Non-Retail Packaging):

Substitution of sub-regulation (1):
Mandatory information for non-retail packaged food:
(a) Name of the food;
(b) FSSAI Logo and License number;
(c) Date marking and storage instructions;
(d) Lot/Batch/Code number;
(e) Name and address of manufacturer or packer (including country of origin for imports).

Substitution of sub-regulation (2):
If not on label, following to be provided in accompanying documents:
(a) List of ingredients;
(b) Veg/Non-Veg declaration;
(c) Net quantity.

Substitution of sub-regulation (4):
Non-retail packages must be clearly identifiable as:
“NON-RETAIL CONTAINER” or
“NON-RETAIL CONTAINER – NOT FOR DIRECT SALE TO CONSUMER”.

Insertion of sub-regulation (5):
“(a) Information and the statements required to appear on the label … shall be clear, prominent, readily legible…
(b) The mandatory information … shall appear in a prominent position…”

  1. Schedule I (Fortified Foods):
    “Every package of food fortified… shall carry the words ‘fortified with … (name of the fortificant)’ and the logo… and may also carry a tag line ‘Sampoorna Poshan Swasth Jeevan’…”
  2. Schedule II (Declarations):
    Insertion:
    “Note: This warning statement shall be clearly legible or audible in advertisements related to Pan Masala”.

Substitution:
“(iv) Not recommended for phenylketonurics; for children; pregnant or lactating women (in case of Aspartame-Acesulfame salt or admixture or combination of Aspartame and Acesulfame Potassium).”

Insertion:
“Provided further that the repetition of information may not be required for combination of sweeteners.”

Substitution (terminology):
“pregnant and lactating mothers” replaced with “pregnant or lactating women”.
