The Act has been introduced to amend multiple existing laws with the objective of decriminalising offences and promoting ease of doing business. It applies across various enactments listed in the Schedule and aims to shift from criminal liability to monetary penalties in several provisions.

  • Multiple enactments have been amended as specified in the Schedule to replace imprisonment provisions with penalties and introduce adjudication mechanisms.
  • Introduction of adjudicating officers and appellate authorities across various laws for imposing penalties instead of criminal prosecution.
  • Provision for periodic increase in fines and penalties:
    “The fines and penalties… shall be increased by ten per cent… after the expiry of every three years…”
  • Saving clause ensures that past actions, liabilities, and legal proceedings remain unaffected by the amendments.
  • Central Government empowered to remove difficulties in implementation within two years from commencement.
