Haryana Occupational Safety, Health and Working Conditions Rules, 2026 – Draft Rules Notified

Applicable Act: Occupational Safety, Health and Working Conditions Code, 2020 (Central Act 37 of 2020)

Haryana Government, Labour Department, has notified draft rules titled the Haryana Occupational Safety, Health and Working Conditions Rules, 2026, extending to the whole State of Haryana. The draft supersedes prior rules applicable under the said Code. Objections and suggestions are invited within thirty days of publication.

The draft rules are structured across thirteen chapters covering the following subject matters.

Chapter I – Preliminary: Defines key terms including Competent Person, Continuous Process, Hazardous Substance, Designated Authority, Portal, and Recognized Institution. The Chief Inspector-cum-Facilitator is empowered to recognize individuals or institutions as Competent Persons for tests, examinations, inspections, and certifications, subject to prescribed qualifications and experience. Competent Persons shall not be above 62 years of age. Recognition applications shall be disposed of within 60 days.

Chapter II – Registration: Employers shall apply for registration electronically through the Labour Department portal. Registration fees are prescribed. The Registering Officer shall dispose of applications within the prescribed period. Appeals against orders of the Registering Officer shall ordinarily be disposed of within thirty days. Employers shall notify commencement and cessation of operations to the Inspector-cum-Facilitator.

Chapter III – Duties of Employer and Employee: Employers shall conduct annual health examinations of employees and issue letters of appointment. Notices of accidents and dangerous occurrences shall be sent to the Inspector-cum-Facilitator, Chief Inspector-cum-Facilitator, District Magistrate, and officer-in-charge of the nearest police station within 60 hours. Notice of occupational diseases shall be sent electronically within 24 hours to the Inspector-cum-Facilitator or Chief Inspector-cum-Facilitator.

Chapter IV – Occupational Safety and Health Advisory Board: The Board shall be constituted as per Section 17 of the Code. Non-official members shall hold office for a specified term. Provisions for resignation, cessation of membership, removal, meetings, and notice of meetings are prescribed.

Chapter V – Hours of Work and Annual Leave with Wages: Provisions relating to hours of work, spread-over, and annual leave with wages are prescribed in accordance with the Code.

Chapter VI – Maintenance of Registers, Records and Returns: Notice of periods of work shall be displayed at conspicuous places and sent to the Inspector-cum-Facilitator electronically or by registered post. Registers, records, and annual returns shall be maintained and filed electronically in the prescribed forms.

Chapter VII – Inspector-cum-Facilitator and Other Authority: Qualifications and experience for appointment as Chief Inspector-cum-Facilitator are prescribed under Section 34(5). The Inspector-cum-Facilitator is empowered to call for records and record statements. Accredited laboratories shall be recognized by the Chief Inspector-cum-Facilitator for sample analysis. Inspection reports shall be prepared after every inspection.

Chapter VIII – Special Provisions Relating to Employment of Women: Special provisions for employment of women are prescribed in accordance with the Code.

Chapter IX – Special Provisions for Contract Labour and Inter-State Migrant Workers: Provisions relating to contract labour and inter-state migrant workers are prescribed.

Chapter X – Offences and Penalties: Provisions relating to offences and penalties under the Code are prescribed.

Chapter XI – Social Security Fund: The Designated Officer of Haryana shall administer the Social Security Fund under Section 115 of the Code.

Chapter XII – Appeals: Appeals against orders of the Inspector-cum-Facilitator in cases involving factories are provided for.

Chapter XIII – Miscellaneous: Residual provisions applicable under the Code are prescribed.
