The Telangana Public Safety (Measures) Enforcement Act, 2013 is a legislation aimed at ensuring public safety and security in the state of Telangana, India.
Objectives:
The primary objective of the act is to provide protection to citizens, their property, uphold public safety, promote peace, and safeguard the rights and interests of its citizens and the overall well-being of society.
Applicability of Law:
The Telangana Public Safety (Measures) Enforcement Act, 2013 is applicable on all establishments, such as commercial establishments, industrial establishments, religious places, educational institutions, hospitals, sports Complexes, railway stations, bus stations, places of organized congregations and such other establishments as the Government, may by notification declare to be an establishment for the purpose of this Act with a likelihood of public gathering of 100 people or more at a time.
Meaning of Public Safety Measures:
Public Safety Measures means Access Controls or Closed-Circuit Television (CCTV) Camera Systems at entry and exit points of the establishments and their designated parking areas by installing-
Inspection of installation of public safety measures
The Inspector of Police with jurisdiction over the area may enter any establishment at any time without prior notice to inspect and verify the installation and functioning of public safety measures. If any defaults or violations are found, the Inspector will report them to the Assistant Commissioner of Police (ACP) or the Sub Divisional Police Officer (SDPO) concerned, as applicable.
Penalties:- In case of failure of any establishment in complying with the directions given in the show cause notice issued pursuant to the inspection report, compounding fee may be levied on the owner or manager or persons running such establishments –
If the owner or manager fails to comply with directions within two months, the Inspector of Police shall temporarily seal the premises and report to the licensing authority through the ACP or SDPO.
Provided that the religious institutions of Endowments Department or any other religious place shall not be sealed.
