Amendment in Import Policy Condition of ATS-8 under ITC HS, 2022

Under Chapter 29 of ITC (HS), 2022, Schedule I (Import Policy), various chemical compounds are classified with corresponding import conditions. Rule-making powers under Section 3 and Section 5 of the Foreign Trade (Development & Regulation) Act, 1992, allow the Central Government to regulate imports for safeguarding domestic industry. Using these powers, the Government has revised the import policy condition of ATS-8 {(4R-Cis)-1,1-Dimethylethyl-6-cyanomethyl-2,2-dimethyl-1-3-dioxane-4-acetate} with immediate effect, shifting it from “Free” to “Restricted” for imports below a specified value threshold.

The import of ATS-8 {(4R-Cis)-1,1-Dimethylethyl-6-cyanomethyl-2,2-dimethyl-1-3-dioxane-4-acetate} is now restricted when its CIF (Cost, Insurance, and Freight) value is less than US$111 per kg, effective immediately. This restriction will remain in force till September 30, 2026.

All other entries under Chapter 29 remain under the “Free” import policy, except for certain items (like Diloxanide furoate, Cimetidine, Oxyclozanide, and Famotidine) which also face the same restriction if imported below the specified value threshold.

Exemption: The Minimum Import Price (MIP) condition will not apply to imports by Advance Authorization holders, Export Oriented Units (EOUs), and units in Special Economic Zones (SEZs), provided that the imported inputs are not sold in the Domestic Tariff Area (DTA).

Effect of the Notification:

ATS-8 imports below US$111/kg are restricted till September 30, 2026.

Imports above this threshold remain free.

Exemptions apply to Advance Authorization, EOUs, and SEZs, subject to non-diversion to DTA.
