Amendments to the Tamil Nadu Shops and Establishments Rules

Applicable Section/Rule: Rule 16-C (as substituted), Form-O (for half-yearly self-certification)

The government of Tamil Nadu has amended the Rules applicable to Shops & Establishments to strengthen compliance oversight for Information Technology-Software and Software-Enabled Services establishments.

  • The existing Rule 16-C is replaced: now every employer in IT/ITES establishments must submit a combined self-certification certificate (Form O) at the end of each half-year.
  • The deadlines are: for the half year ending 30 June — certificate by 31 July; for half year ending 31 December — certificate by 31 January of the next year.
  • Form-O (revised) captures key compliance details: employment numbers (male, female, total), daily/weekly working hours compliance, leave with wages, maintenance of statutory registers (wages, employment, leave, social-security), display of required notices (minimum wage, wage payment date, name board, abstracts of relevant Acts/Rules), wage-slip issuance, maternity & gratuity compliance, wage payments, and adherence to wage and payment laws.
  • Employers must sign the certificate, and it must be submitted online to the Assistant Inspector of Labour. Non-compliance or furnishing of incorrect information may lead to prosecution under the Act/Rules.
