Background

The Rajasthan Public Trusts Act, 1959 governs the registration, administration, and regulation of public trusts in the state. Registration ensures transparency, proper governance, and legal recognition of trusts created for charitable, religious, or social purposes. The Assistant Commissioner, under the supervision of the Commissioner, is the designated authority for registration and record maintenance of public trusts.

Applicability

The provisions apply to:

  • All public trusts created or existing within the jurisdiction of Rajasthan.
  • Trustees or working trustees responsible for registering the trust within the prescribed timelines.

Compliance Requirements for Registration

Provisions under Section 17 of the Rajasthan Public Trust Act, 1959:

  • Application must include details of:
    • Origin, nature, and object of the trust
    • Address of principal office
    • Names and addresses of trustees and manager
    • Mode of succession to office of trustee
    • Full list and particulars of trust property (movable & immovable)
    • Approximate value of property
    • Average annual income/expenditure (based on last 3 years or estimate for newly created trust)
    • Communication address of trustee/manager
    • Any other particulars as prescribed
  • Application must enclose:
    • Copy of trust deed/instrument (if executed)
    • Record of rights extract for immovable property

Provisions under the Rajasthan Public Trust Rules, 1962

Application for Registration (Rule 17):

  • Application must be filed within three months from the date of applicability of this section to a public trust, or from the date of creation of the trust, whichever is later.
  • The Assistant Commissioner may grant an extension up to two years, with recorded reasons.
  • Application to be filed in Form 6 and signed/verified as per Code of Civil Procedure, 1908.
  • Must include particulars beyond Section 17(4), such as:
    • Other sources of income
    • Encumbrances on trust property
    • Title details and instrument of trust (if executed)
    • Names of trustees in possession
    • Particulars of schemes, if any, relating to the trust
  • Registration Fee (Rule 18) :
    To be paid in cash and credited to the Consolidated Fund of the State as specified in the rule.
  • Certification of Registration (Rule 19):

On successful registration, the Assistant Commissioner issues a Certificate of Registration, bearing the office seal and signature.

  • Certificate includes:
    • Name of the trust
    • Registration number
    • Date of registration
    • Trustee to whom issued

Penalty & Punishment

As per Section 70 – Penalty:

  • Whoever contravenes any provision of sub-section (1) of section 17 or sub-section (1), (2) and (5) of section 66 shall be published with time which may extend to five hundred rupees.
  • Whoever contravenes any of the provisions of this Act or the rules made there under for the contravention of which no specific penalty has been provided shall be punished with fine which may extend to one hundred rupees.
