Key Compliances under Food Safety and Standards (Packaging) Regulations, 2018 [Section 3 & 4]

The Food Safety and Standards (Packaging) Regulations, 2018 were issued by the Food Safety and Standards Authority of India (FSSAI) to establish uniform standards for materials that come in direct or indirect contact with food. These regulations were framed under the Food Safety and Standards Act, 2006 in response to rising concerns over contamination, chemical migration, and safety risks associated with food packaging. They introduced clear definitions, material-wise specifications, and restrictions on packaging substances such as plastics, paper, glass, and metals to ensure food safety through the entire supply chain.

Registration & Licensing Under FSSAI

The Food Standards and Safety Authority of India (FSSAI) is the primary authority in charge of regulating and supervising food safety. Under the direction of the FSSAI, all organizations engaged in the food industry in India from production and processing to distribution and retailing must obtain an FSSAI license or registration. FSSAI Registration differs from FSSAI License based on the size and nature of the firm. Food Business Operators (FBOs) should obtain the appropriate registration or license based on the size of their business.

Compliances under Food Safety and Standards (Licensing and Registration of Food Businesses), Regulations 2011

The Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011(FSSR), were notified by the Food Safety and Standards Authority of India (FSSAI) under the powers granted by Section 31 read with clause (o) of sub-section (2) of Section 92 of the Food Safety & Standard Act, 2006 (FSS). The draft regulations were first published in October 2010, and after considering public suggestions, they were officially enforced to streamline the licensing and registration process for food businesses in India.
