CMV(Amendment) Rules, 2026 – Draft Amendment on Vehicle Height and Load Cover Systems

Applicable Section / Rule: Rule 93 and Rule 138-B

The Central Motor Vehicles Rules, 1989 prescribe requirements relating to vehicle dimensions and safety standards for motor vehicles, including provisions for measuring overall height and operational safety of specific vehicle categories such as tippers and dumpers. The present notification publishes draft rules proposing amendments to these provisions and invites objections or suggestions within thirty days.

  1. Insertion under Rule 93 (Sub-rule 1, clause (A))

“Provided that in case of tippers and dumpers, the system fitted to enclose the load body, as per the provision given in the second provision of CMV Rule 138-B, shall not be taken into consideration in measuring the overall height of motor vehicles.”

  1. Substitution under Rule 93 (Sub-rule 1, clause (B), item (i))

“(i) A rear view mirror or device for indirect vision, or guard rail or a direction indicator rub-rail (rubber beading) having maximum thickness of 20 millimeter on each side of the body or side foot step, or the system fitted on tippers and dumpers to enclose the load body as per the provision given in second provision of CMV Rule 138-B, shall not be taken into consideration in measuring the overall height of motor vehicles.”

  1. Insertion under Rule 138-B (after first proviso)

“Provided also that on and after 1st April 2027, in the case of all dumper and tippers, the load body shall be fitted with an electrically or electro-mechanical or hydraulic or mechanically operated system to cover the load body from top, to fully enclose the load body while the vehicle is plying on the road. The system specified above may use any suitable material for covering the roof of the load body. Additionally, an audio-visual alert system shall be provided in the driver’s cabin to warn the driver if the load body cover is open or unsecured during vehicle movement.”
