The Machinery and Electrical Equipment Safety (Omnibus Technical Regulation) Order, 2024 was introduced by the Ministry of Heavy Industries to establish a unified safety and quality framework for machinery and electrical equipment in India.

Compliances Related to Machinery and Electrical Equipment Safety (Omnibus Technical Regulation) Order, 2024

Background:

 

The Machinery and Electrical Equipment Safety (Omnibus Technical Regulation) Order, 2024 was introduced by the Ministry of Heavy Industries to establish a unified safety and quality framework for machinery and electrical equipment in India. Issued under the Bureau of Indian Standards Act, 2016, the Order mandates compliance with prescribed Indian Standards through compulsory BIS certification. Its primary aim is to reduce safety risks, enhance product reliability, and ensure uniform technical requirements across domestically manufactured and imported products. The regulation covers a wide range of machinery, electrical equipment, and related assemblies used across industries. By providing a structured compliance regime with phased enforcement, the Order seeks to strengthen consumer protection while allowing industry adequate time to adapt.

Applicability:

This Order shall apply to machines and electrical equipment listed in the first Schedule annexed to this Order from the 1st September, 2026. However, to the assemblies, sub-assemblies and components listed in the first Schedule, this Order shall apply from such date as may be notified by the Central Government in the Official Gazette

Nothing in this Order shall apply to:

  • any machinery or electrical equipment and their assemblies, sub-assemblies or components covered under any other order made under section 16 of the Bureau of Indian Standards Act, 2016.
  • goods or articles manufactured domestically for export & for Construction Equipment’s covered under CMVR Rule 1989 issued by MoRTH.

 

Compliance Requirements under the Order

  1. Adherence to Type A, B & C Indian Standards for Machinery and Equipment (Para 3(1))

Each machine, or as the case may be, electrical equipment specified in the first Schedule shall conform to the corresponding Indian Standards, as applicable, as given below:-

(a) Type A standards as given below: IS 16819:2018/ISO 12100:2010 (Safety of Machinery General Principles for Design- Risk Assessment and Risk Reduction and,

(b) Type B Standards –as per the second schedule;

(c) Type C Standards – as per the third Schedule:

Provided that if a Type C standard deviates from one or more technical provisions dealt with by Type A or Type B standard, Type C standard takes precedence

  1. Labelling and Marking of Machinery and Electrical Equipment (Para 3(2))

Each machine, or as the case may be, electrical equipment, specified in the first Schedule shall conform to the labelling and marking requirements as provided in the Scheme X of the Conformity Assessment Regulations and also to be complied with the safety instructions or symbols, if any required to be labelled or marked on the machinery or electrical equipment, as the case may be.

  1. Maintenance of Technical File under Scheme X (Para 3(3))

Requirement of technical file shall be complied with as provided in the Scheme X of the Conformity Assessment Regulations.

  1. BIS Certification and Registration of Machinery and Equipment (Para 4)

(a) Compulsory certification.––Each machine or electrical equipment, as the case may be, specified in the first Schedule shall bear the standard mark under a license from the Bureau; or issued with a certificate of conformity in case of machine, or as the case may be, electrical equipment, is not desired to be manufactured on a continuous basis as provided in the Scheme X of the Conformity Assessment Regulations.

(b) Prior to obtaining license or certificate of conformity under para 4(a) of this order, manufacturer of each machinery or electrical equipment, as the case may be, specified in the first schedule shall register with the BIS.

  1. Market Surveillance as per BIS Guidelines (Para 6)

The market surveillance in respect of any machine or electrical equipment, as the case may be, under these rules, shall be governed by such guidelines as may be issued time to time.

Penalties & Punishment

  • Para 7 deals with penalty as per the provisions of BIS Act and Section 17(1) (b) of the BIS Act states that notwithstanding that a person has been granted a license, apply a Standard Mark, unless such goods, article, process, system or service conforms to the relevant standard or prescribed essential requirements.
  • Accordingly for contravention of Section 17, Section 29(3) provides punishment with imprisonment for a term which may extend up to two years or with fine which shall not be less than two lakh rupees for the first contravention and not be less than five lakh rupees for the second and subsequent contraventions, but may extend up to ten times the value of goods or articles produced or sold or offered to be sold or affixed or applied with a Standard Mark, including Hallmark, or with both.
  • For contravention of the provisions of the Order, such penalty as deemed fit may be imposed by appropriate authority under the BIS Act 2016.

Note: Machinery and Electrical Equipment Safety (Omnibus Technical Regulation) Order, 2024 has been rescinded vide Not. no. S.O. 239(E). dated 14.01.2026
