Draft Amendment to Environment Protection (End-of-Life Vehicles) Rules, 2026

The Environment Protection (End-of-Life Vehicles) Rules, 2025 were earlier notified to regulate environmentally sound management of end-of-life vehicles. Stakeholders raised concerns regarding implementation of these provisions. Accordingly, the Central Government has issued draft amendments and invited objections or suggestions within sixty days from the date of publication.

  1. Insertion in Rule 3 (Definitions)
    A new clause is inserted defining “Extended Producer Responsibility” in relation to waste management rules notified under the Environment (Protection) Act, 1986.
  1. Amendment in Rule 4

Substitution of clause (viii):
Producers shall declare details of vehicles placed in the domestic market during FY 2005-06 to FY 2024-25, including material composition such as steel, tyres, oil, electrical and electronic components, batteries and plastic, by June 30, 2026 in Form 9 on the EPR portal.

Insertion of clause (xii):
Obligation to meet minimum usage of recycled steel in total vehicle weight.

Insertion of sub-rules (8), (9), (10):
Producers shall fulfil Extended Producer Responsibility obligations for waste categories including steel scrap, used oil, waste tyres, batteries, e-waste and plastic waste arising from end-of-life vehicles; submit details of responsible entities; and furnish compliance reports in prescribed Form 1.

  1. Insertion of Rule 8A and 8B

Rule 8A – Responsibilities of Insurance Companies/Insurers:
Insurance companies shall register on the centralized portal, ensure environmentally sound management of end-of-life vehicles, deposit such vehicles at registered scrapping facilities, and upload details on the portal.

Rule 8B – Responsibilities of IRDAI:
The Authority shall regulate and enforce compliance of insurers regarding environmentally sound management and scrapping of such vehicles.

  1. Amendments in Rule 9
    • Omission of specific words relating to steel scrap.
    • Insertion of new provision stating that Extended Producer Responsibility certificates for waste (other than steel scrap) shall be generated through the centralized portal developed by the Central Board.
  2. Insertion of Rule 9A – Use of Recycled Material

Producers shall comply with minimum usage of recycled steel in new vehicles, as specified in the schedule (minimum 10% across specified periods).

  1. Amendments in Rule 12 and Rule 14
    Scope expanded to include bulk consumers, insurance companies/insurers and other entities required to be registered under the rules.
  1. Substitution of Schedule (EPR Targets)
    Revised Extended Producer Responsibility targets prescribed year-wise for transport and non-transport vehicles, specifying minimum percentage of steel recovery across future financial years.
  2. Substitution and Insertion of Forms
    • Form 1 (Revised): Annual return including material-wise details and EPR compliance.

                    Form 9 (Inserted): Declaration of vehicles introduced in domestic market along with material composition.
