EPFO Simplifies Death Claims – Guardianship Certificate Not Required

Applicable Act/Rule – Employees’ Provident Funds and Miscellaneous Provisions Act, 1952

EPFO had been facing delays in processing death claims where surviving minor children of deceased members were legal beneficiaries. Many regional offices were insisting on production of Guardianship Certificates from courts before releasing funds, which caused hardship and prolonged settlement timelines for families

To simplify procedures and ensure speedy settlement of claims, EPFO has clarified that:

  • No Guardianship Certificate shall be required if settlement proceeds are credited directly into the bank accounts of surviving minor children.
  • Claimants should be guided to open individual bank accounts in the name of minor children for receiving PF settlement and pension amounts.
  • This measure is intended to reduce unnecessary delays and provide financial support to beneficiaries at the earliest.
