Exemption for IT/ITES & Knowledge-Based Industries from Standing Orders Act

Applicable Act/Rule – Industrial Employment (Standing Orders) Act, 1946

The Government of Haryana has exercised its powers under Section 14 of the Industrial Employment (Standing Orders) Act, 1946 to grant a temporary exemption to IT/ITES and other knowledge-based industries.

The notification grants a five-year exemption from the applicability of the Industrial Employment (Standing Orders) Act, 1946 to IT/ITES, Startups, Animation, Gaming, Computer Graphics, Telecom, GCC, BPO, KPO and other knowledge-based industry establishments.

This exemption is conditional. Establishments must constitute an Internal Committee under the Sexual Harassment of Women at Workplace Act, 2013, ensuring statutory compliance on workplace safety.

They must also create a Grievance Redressal Committee with equal representation from employer and employee sides to resolve all types of employee grievances within reasonable timelines.

Employers are obligated to report disciplinary actions such as suspension, termination, dismissal, demotion or discharge to both the Jurisdictional Deputy Labour Commissioner and the Labour Commissioner. Further, any service-condition-related information sought by these authorities must be furnished promptly and completely within the prescribed time. The exemption will cease to hold if the Industrial Relations Code, 2020 comes into force, in which case the Code will apply universally.
