Extension of Project Registration – West Bengal RERA

Applicable Act/Rule – Real Estate (Regulation and Development) Act, 2016 [West Bengal]

The West Bengal Real Estate Regulatory Authority (WBRERA) has issued guidelines for extending project registrations where applications are filed late or for periods beyond one year from the declared completion date. This aims to protect homebuyers’ interests while ensuring timely compliance by promoters.

The circular clarifies the framework for late extension applications under Section 6 and Rule 7:

  • Eligibility: Extensions may be allowed if 80–90% of construction is complete. Promoters must file an affidavit explaining reasons for delay, supported by documents, and propose a revised completion date.
  • Procedure: WBRERA will evaluate cases individually, may conduct hearings, and will record orders in writing with reasons.
  • Delay Charges for Filing Applications:
    • Up to 3 months: up to 50% of extension fees.
    • 3–6 months: up to 100% of extension fees.
    • 6–12 months: up to 150% of extension fees.
    • More than 1 year: charges decided case-by-case.
  • Late Charges for Execution of Extension:
    • Up to 3 months: up to 30% of fees.
    • 3–6 months: up to 60% of fees.
    • 6–12 months: up to 90% of fees.
    • Beyond 1 year: rejection possible or penalty up to 5% of estimated project cost.
  • Other Conditions: Applications must be in Form ‘E’. Extensions will only be granted if beneficial for allottees. Promoters must submit additional documents if required and comply with all orders of WBRERA.
