Haryana Draft Social Security Rules, 2026

Code on Social Security, 2020 was enacted by Parliament. All provisions of the Code were brought into force vide Central Notification No. S.O. 5319(E) dated November 21, 2025. The Haryana Government has published the draft Code on Social Security (Haryana) Rules, 2026 in supersession of six existing rules: (i) The Haryana Maternity Benefit Rules, 1967; (ii) The Haryana Payment of Gratuity Rules, 1972; (iii) The Haryana Unorganized Workers Social Security Rules, 2010; (iv) The Punjab Employees’ Insurance Courts Rules, 1951 as applicable to Haryana; (v) Employment Exchanges (Compulsory Notification of Vacancies) Rules, 1960; and (vi) The Haryana Building and Other Construction Workers Welfare Board Rules, 2005 — except as respects things done or omitted to be done before such supersession.

The draft rules extend to the whole of the State of Haryana in respect of industrial establishments and matters for which the State Government is the Appropriate Government. The rules are structured across fifteen chapters.

  • Chapter 1 covers preliminary provisions including definitions and electronic registration of establishments, with certificate issuance within seven days and deemed registration upon failure to issue within that period.
  • Chapter 2 addresses the constitution, membership, meetings, and procedures of the Haryana Unorganized Workers Social Security Board and the Haryana Building and Other Construction Workers’ Welfare Board.
  • Chapter 3 prescribes gratuity nomination, application, appeal, and recovery procedures, including an Explanation specifying exclusions from wage for gratuity computation.
  • Chapter 4 provides for maternity benefit appeals to the Deputy Labour Commissioner.
  • Chapter 5 covers employee compensation including fatal accident reporting, funeral expenses of not less than twenty thousand rupees, half-monthly payment review, commutation, memoranda of agreement, and proceedings before the Competent Authority.
  • Chapter 6 prescribes maintenance of registers and records, wage slips, and annual returns.
  • Chapter 7 prescribes the procedure for compounding of offences under Section 138.
  • Chapter 8 covers group insurance, educational assistance, medical expense schemes for beneficiaries, property transactions, investment of moneys, loans, appointment and service conditions of Board Chairperson, Members and Secretary, financial powers, and write-off of irrecoverable dues.
  • Chapters 9 to 14 prescribe constitution, jurisdiction, conditions of service of Judges, and procedure of the Employees’ Insurance Court, including execution of orders and repeal of the Punjab Employees’ Insurance Courts Rules, 1951 as applicable to Haryana.
  • Chapter 15 prescribes establishment and functioning of Regional Career Centres, vacancy reporting by employers and aggregators in Form 32, submission of annual Employment Information Return in Form 33, maintenance of records, and levy of penalties under Section 133.

The notification contains thirty-three forms. Objections and suggestions may be submitted to the Labour Commissioner, Haryana, 30 Bays Building, Sector-17B, Chandigarh, or by email at haryanassrules@gmail.com, within forty-five days from the date of Gazette availability.
