The notification is issued by the Labour Department, Government of Haryana.
The notification exempts establishments situated in the State of Haryana and covered under the Haryana Shop and Commercial Establishments Act, 1958 from the operation of provisions relating to registration or intimation of business commencement under Section 13 or Section 13A of the Act and the rules framed thereunder, subject to registration under Section 3 of the Occupational Safety, Health and Working Conditions Code, 2020 after finalization of the Haryana Rules.
The exemption applies to establishments registered under the Occupational Safety, Health and Working Conditions Code, 2020. The notification further states that such establishments are required to continue complying with other provisions of the Haryana Shop and Commercial Establishments Act, 1958 to the extent such provisions are not inconsistent with the Occupational Safety, Health and Working Conditions Code, 2020.
“In exercise of the powers conferred by Section 28 of The Haryana Shop and Commercial Establishments Act, 1958 (Punjab Act 15 of 1958) read with Rules framed under the said Act, and all the powers enabling him in this behalf the Governor of Haryana hereby exempts any “Establishment” situated in the State of Haryana and covered under the above Act, which gets itself registered under Section 3 of The Occupational Safety, Health and Working Conditions Code, 2020 (Act 37 of 2020) after finalization of the Haryana Rules; from the operation of the provisions of Registration or Intimation of Business Commencement under Section 13 or Section 13A of the above said Act and the Rules framed thereunder in order to avoid duplicacy of registration and compliance process.
Provided that the Establishment must continue to comply with the other provisions of the Haryana Shop and Commercial Establishments Act, 1958 (Punjab Act 15 of 1958) to the extent they are not inconsistent with The Occupational Safety, Health and Working Conditions Code, 2020 (Act 37 of 2020).”
