Haryana Prescribes Conditions for Employing Women in Night Shifts in Factories

Under Section 66(1)(b) of the Factories Act, 1948, women are restricted from working during night shifts unless specifically exempted by the State Government. This notification by Haryana Government supersedes all previous notifications and sets out updated safety and operational conditions for granting such exemptions. There has been a slight modification as compared to the earlier Notification released on May 8, 2025. [Conditions for Employing Women in Night Shifts in Factories – Haryana]

Government of Haryana has laid out the following conditions for factories seeking exemption from restrictions on women’s night shift employment:

Note: Such exemption shall be valid for one year from the date of issuance of the notification.

  • Written consent must be obtained from each woman employee (including security staff and supervisors) for night shift work.
  • The provisions of Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 shall be complied with by the occupier of the factory.
  • Adequate lighting and CCTV coverage must be ensured inside and around the factory premises.
  • Women must be employed in batches of at least four during the night shift.
  • Safe transportation facilities from home to workplace and back must be provided, with security guards (including at least one female guard), trained drivers, GPS, and CCTV-enabled vehicles. Women may opt out of this facility via written consent.
  • Factories may pool transport and medical facilities by tying up with external service providers or nearby hospitals.
  • A medical setup, including a doctor or female nurse, must be available during night shifts; emergency contacts must be prominently displayed.
  • All relevant provisions under the Factories Act, Equal Remuneration Act, and other applicable labour laws must be followed, including hours of work, rest, canteen/restrooms for women, and holidays.
  • Any untoward incident must be reported to the Assistant Director, Industrial Safety & Health and local police station immediately.
  • The application for exemption must be made online within 2 weeks of commencing night shifts for women, and approval will be granted through auto-mode based on self-certification.
