Karnataka Lifts, Escalators and Passenger Conveyors Act, 2012

Background

The Karnataka Lifts, Escalators, and Passenger Conveyors Act was enacted to regulate the safe installation, operation, and maintenance of lifts, escalators, and passenger conveyors within the state. The Act ensures that owners obtain necessary permissions, adhere to safety norms, and maintain proper records. Its purpose is to safeguard public safety, prevent accidents, and enforce accountability on owners and operators.

Applicability

The Act applies to every owner of a place intending to erect, install, or operate a lift, escalator, or passenger conveyor in Karnataka. It governs the process of obtaining permissions, licenses, accident reporting, and maintenance obligations.

Compliance Requirements under the Act in Accordance with the Karnataka Lifts, Escalators and Passenger Conveyors Rules, 2015

  • Form-A1/A2: Permission for installation of lift or escalator or passenger conveyor (Section 3 / Rule 3)

Every owner intending to install a lift, escalator, or passenger conveyor must apply for permission in Form A1 (for lifts) or Form A2 (for escalators/passenger conveyors) to the authorized officer under Section 13(2) of the Act. Every application must be accompanied by: (a) computer print or blueprint of drawing drawn to scale 1:100 of installation in quadruplicate, signed by applicant and registered person; (b) copy of building plan approved by competent authority certified by notary; (c) copy of khata certificate along with latest tax paid receipt; (d) MOA & AOA (for company), partnership deed (for partnership) along with tax details & Authorization Letter on Rs. 100 stamp paper; (e) original Treasury challan for fee payment; (f) Declaration in Form-A3 from the registered person responsible for installation/erection. Permission is granted in Form-A4 and valid for one year. Non-compliance may lead to fine up to ₹10,000 or imprisonment up to 6 months or both; continuing contravention attracts additional fine of ₹100/day.

  • License to use a Lift or Escalator or Passenger Conveyor (Section 4 / Rule 4)
    After installation, the owner must apply in Form-B1 for a usage license to the authorized officer under Section 13(2), enclosing the completion report (Form-B2/B3), inspection fee receipt (Annexure 4), and manufacturer’s test certificates. License is granted in Form B5 for lifts and Form B6 for escalators or passenger conveyors. Renewal must be applied three months before expiry in Form-C1 with original license and test certificates (Form-C2 for lifts, Form-C3 for escalators/conveyors) along with renewal fee. License is valid for 10 years and renewable every 5 years. Non-compliance may lead to fine up to ₹10,000 or imprisonment up to 6 months or both; license may also be suspended or canceled by the Chief Inspector.
  • Terms on which lift or escalator shall be operated (Section 7 / Rule 12)
    Lifts, escalators, and passenger conveyors must be installed and operated as per BIS codes, Electricity Act, and relevant regulations. Owners must ensure separate electrical connection, obtain Chief Inspector license for electricity supply, maintain contracts with registered persons for maintenance and testing every 3 months. Buildings (non-residential, height >15m) must have trained lift operators (≥18 yrs) with Form F certificate forwarded to Inspector. Unsafe lifts must not be operated; only registered persons may interfere with equipment. Non-compliance may lead to fine up to ₹10,000 or imprisonment up to 6 months or both; license may also be suspended or canceled.
  • Form H1: Register containing particulars as specified in Maintenance Log Book (Rule 12(4)(ii))
    Every owner shall maintain a register in Form H1 and ensure minimum maintenance work is carried out and results recorded by a registered person. For lifts: clean/lubricate guides, examine ropes & safety devices, lubricate door locks & moving parts, check electrical connections. For escalators/passenger conveyors: clean pits, lubricate moving parts, examine balustrade & safety devices, inspect machinery, wiring, and earthing. Non-compliance may lead to fine up to ₹10,000 or imprisonment up to 6 months or both; license may also be suspended or canceled.
  • Form C2/C3: Submission of Annual Testing and Maintenance Report (Rule 12(4)(iii))
    Owners must obtain annual testing and maintenance reports from registered persons in Form-C2 (lifts) or Form-C3 (escalators/conveyors) and submit copies to the authorized officer or inspector. Reports are also required during license renewal. Non-compliance may lead to fine up to ₹10,000 or imprisonment up to 6 months or both; license may also be suspended or canceled.
  • Caution Board to be displayed during maintenance (Rule 12(9))
    Whenever a lift, escalator, or passenger conveyor is under maintenance, the owner or agent must display a caution board near landing doors (lifts) or in conspicuous positions (escalators/conveyors). Non-compliance may lead to fine up to ₹10,000 or imprisonment up to 6 months or both; license may also be suspended or canceled.
  • Display in Lift Car & near Escalators/Passenger Conveyors (Rule 12(10))
    Owners must display: (i) Do’s & Don’ts for user safety, (ii) contact names & phone numbers for emergencies, and (iii) load plate showing rated load in persons and kilograms. Non-compliance may lead to fine up to ₹10,000 or imprisonment up to 6 months or both; license may also be suspended or canceled.
  • Form-A1/A2: Additions/Alterations to lift/escalator installation (Section 8 / Rule 15)
    For any additions or alterations, the owner must obtain prior approval from the authorized officer by filing Form-A1 (lifts) or Form-A2 (escalators/conveyors) along with the applicable fee. Non-compliance may lead to fine up to ₹10,000 or imprisonment up to 6 months or both.
  • Intimation of accident in operation (Section 11 / Rule 14)

Any accident involving a lift, escalator, or passenger conveyor must be reported by owner/agent to the authorized officer, Commissioner of Police, and District Magistrate within 24 hours via phone. The installation must not be interfered with and cannot resume operation without written permission. Detailed report in Form K with registered person’s report to be submitted within 48 hours. Non-compliance may lead to fine up to ₹10,000 or imprisonment up to 6 months or both.

  • Unused Lift or Escalator/Passenger Conveyor (Rule 16)

If a lift, escalator, or passenger conveyor is no longer in use, the owner must either dismantle it with permission or disconnect from power and maintain safely, informing Inspector and Chief Inspector. All gates and doors must be locked to prevent unauthorized access. Non-compliance may lead to fine up to ₹10,000 or imprisonment up to 6 months or both.

  • Periodical inspection and testing (Section 14 / Rule 17)

Lifts, escalators, or passenger conveyors must be tested and maintained quarterly by a registered person, with a register maintained for each inspection. Annual testing and maintenance report must be submitted to the authorized officer or inspector. Non compliance may lead to fine up to ₹10,000 or imprisonment up to 6 months or both.

  • Transfer of license (Rule 18)

License transfer may be allowed upon application with title deed, encumbrance certificate, Khata certificate, and fee payment as per Annexure 4 to the Chief Inspector. Non-compliance may lead to fine up to ₹10,000 or imprisonment up to 6 months or both.

  • Maintenance of lifts, escalators, or passenger conveyors (Section 15)
    Every owner must contract a registered person for maintenance including cleaning, oiling, adjusting, and repairing. Any dispute under the maintenance contract shall be resolved through arbitration in Karnataka. Non-compliance may lead to fine up to ₹10,000 or imprisonment up to 6 months or both.

Penalties & Punishments

U/s 19:Whoever contravenes any of provisions of this Act, rules or conditions of a licence or registration or a direction given by such officer as the Government may authorize under this Act or the rules shall be punishable with fine which may extend to ten thousand rupees or  simple imprisonment which may extend to six months or both.In the case of a continuing contravention with a further fine  which may extend to one hundred rupees, for every day after the first during which the breach has continued.

Rule 16: If the licensee has contravened any of the provisions of the Act or rules or any of the conditions of the licence or directions given to him, the Chief Inspector of Lifts, Escalators & Passenger conveyors, may after giving reasonable opportunity of being heard, suspend or cancel the licence of lift or escalator or passenger conveyor for such period as he thinks fit or cancel it.
