The Act provides specific restrictions on noise during sensitive hours and near sensitive locations such as hospitals, courts, and educational institutions.
Applicability
The Act applies to all establishments, individuals, and institutions in Rajasthan that may use or permit the use of loudspeakers, sound amplifiers, or other noise-emitting devices. It covers restrictions based on time (particularly night hours) and distance (around sensitive premises), ensuring that noise levels are kept within acceptable limits for public health and order.
Compliance requirements under the Act in accordance with the Rules
Nocturnal noise from an establishment which may cause annoyance or serious inconvenience to the public is prohibited. Any noises produced during such night hours as may be specified in the notice issued by the appropriate authority, whether vocally or by a loud-speaker, sound amplifier, or otherwise, which are likely to cause annoyance or serious inconvenience to the public shall be treated as nocturnal noise and are not permitted.
No establishment shall play a loud-speaker or sound amplifier within a distance of 150 meters from hospitals, telephone exchanges, educational institutions during their working hours, student hostels, or courts and government offices during working hours. The restriction applies to broadcasting any speech, sermon, music, radio-programme, or attaching the same to a wireless receiving set or gramophone within such distance.
No loud-speakers shall be used or played between 11:00 p.m. and 5:00 a.m. without the written permission of the prescribed authority. This restriction shall not apply to the use in a place, other than a public place, of a sound amplifier which is a component part of a licensed wireless apparatus being lawfully used.
