Key Compliances under the Andhra Pradesh Water (Prevention and Control of Pollution) Rules, 1976

Background

The Andhra Pradesh Water (Prevention and Control of Pollution) Rules, 1976 were framed under the Water (Prevention and Control of Pollution) Act, 1974 to regulate and control water pollution in the state. These rules empower the Andhra Pradesh Pollution Control Board (APPCB) to issue directions, monitor compliance, and ensure that industries, factories, mines, and other establishments adopt measures to prevent and control water pollution. The rules also provide procedures for obtaining consent, submission of compliance statements, auditing of environmental practices, installation of monitoring systems, and scientific waste disposal.

Applicability

The rules are applicable to every person or occupier carrying on any industry, factory, mine, operation, or process and all other activities that require consent under the Water (Prevention and Control of Pollution) Act, 1974. Any establishment discharging effluents or handling hazardous wastes within Andhra Pradesh must comply with the provisions of these rules, including submission of annual and audited compliance statements, online monitoring, and scientific disposal of effluents and waste.

Compliance requirement under the Rule in accordance with the Notification

  • Submission of Annual Compliance Statement under Andhra Pradesh Water Rules, 1976 (Rule 33A, Andhra Pradesh Water (Prevention and Control of Pollution) Rules, 1976, Amendment to rules by Notification dated 05.11.2021)
    • Every person or occupier carrying on any industry, factory, mine, operation or process and all the other activities which require consent under Water (Prevention and Control of Pollution) Act, 1974 shall, submit Annual Compliance Statement to the Andhra Pradesh Pollution Control Board in the prescribed format every year on or before 30 September along with Environmental Statement as required under Rule 14 of the Environment (Protection) Rules, 1986.
    • Above statements to be placed on the website of the person/occupier as well as on the website of APPCB with a provision to obtain comments/remarks from any Indian resident for a minimum period of 15 days.

Annual Compliance Statement to be submitted along with Environmental Statement as required under Rule 14 of the Environment (Protection) Rules, 1986.

  • Submission of Audited Annual Compliance Statement (Water) by Factory in Andhra Pradesh (Rule 33C, Andhra Pradesh Water (Prevention and Control of Pollution) Rules,1976, Amendment to rules by Notification dated 05.11.2021)
    • APPCB may notify the date and type of industries and activities that are required to submit Audited Annual Compliance Statement and Audited Environmental Statement..
    • The Annual Compliance Statement and Environmental Statement shall be audited by an Environment Quality Assessment Auditor empanelled and notified by the APPCB.
  • Installation of Online Monitoring System (Water) in Factory in Andhra Pradesh (Rule 39, Andhra Pradesh Water (Prevention and Control of Pollution) Rules, 1976, Amendment to rules by Notification dated 05.11.2021)

APPCB may notify any person or occupier carrying on any industry, factory, mine or operation or process to install online effluent quality monitoring system and transmit monitoring data online real time to centralized monitoring stations at the Head/Zonal/Regional offices of the APCCB.

  • Scientific Waste Disposal (Water) in Factory in Andhra Pradesh (Rule 40, Andhra Pradesh Water (Prevention and Control of Pollution) Rules, 1976, Amendment to rules by Notification dated 05.11.2021)

Every person or occupier carrying on any industry, factory, mine or operation or process and all the other activities which require consent under Water (Prevention and Control of Pollution) Act, 1974 shall ensure adequate treatment of waste and ensure scientific disposal of trade effluent, hazardous and other wastes through authorized agencies as notified by APPCB to enable continuous waste disposal monitoring.

Penalties & Punishments

  • For late submission, late fees to be paid as specified in Act/Rules. Besides other actions, inspection may be taken up u/s 23 of Water (Prevention and Control of Pollution) Act, 1974
  • If pollution parameters are exceeded, corrective measures will be notified and the APPCB may determine amount of Environmental compensation payable
  • Any person or occupier who fails to dispose trade effluent, hazardous and other wastes to the notified authorised agencies shall be treated as unscientific disposal liable for action under Water (Prevention and Control of Pollution) Act, 1974.
    Further it shall be presumed that the trade effluent, hazardous and other wastes are disposed by the person / occupier in an unauthorized manner and he may be liable to pay Environmental Compensation for such disposal for the entire quantity.
