Modification Utility and Levy of Fee for Delayed CIRP Form Filing

Notification/Circular No. – IBBI/CIRP/89/2025 dated December 18, 2025

Applicable Act/Rule – Insolvency and Bankruptcy Code, 2016, IBBI (Insolvency Resolution Process for Corporate Persons) Regulations, 2016

Applicable Section/Rule – Regulation 40B of the CIRP Regulations

Insolvency and Bankruptcy Board of India introduced revised CIRP forms effective June 01, 2025. During implementation, Insolvency Professionals reported errors and omissions in forms already filed and sought a mechanism to correct them.

A Modification Utility has been introduced on the IBBI electronic platform, enabling Insolvency Professionals to modify already submitted CIRP forms to rectify errors or omissions. Such modifications must be authenticated through an OTP-based process. Where a form is originally submitted before the due date and any modification is also completed before the due date, no fee shall be payable, as fee computation under Regulation 40B(4) begins only after the last due date of the form.

IBBI has further notified the commencement of levy of fee for delayed filing of CIRP forms. For all forms that were due on or before December 31, 2025, and are submitted after that date—whether by correction, updation, or otherwise—a fee of ₹500 per form per calendar month of delay (excluding GST) shall be payable until the date of submission. This marks the end of the initial relaxation period provided earlier for delayed filings.
