Notification No./Circular No. – No. BO/MPCB/AS(T)/Circular/B-39 dated August 25, 2025
Applicable Act/Rule – Water (Prevention & Control of Pollution) Act, 1974; Air (Prevention & Control of Pollution) Act, 1981
Following CPCB’s February 12, 2025 directions on sector classification and MoEF&CC’s guidelines for consent timelines and lapse resolution, the Government of Maharashtra constituted a State Level Monitoring Committee (SLMC) on March 7, 2025. During consent reviews, MPCB found that industries often submit amendment requests for changes that should be processed as fresh or revised consents, resulting in unnecessary delays.
MPCB has now clarified that only three categories of requests will qualify as amendment applications:
Valid Amendments | Examples |
Typographical or clerical errors | Spelling mistakes, minor corrections in consent order |
Change in industry name | Supported by legal documents or registration proof |
Change in hazardous waste disposal path | Allowed for pre-processing or co-processing as per MPCB policy |
All other requests such as addition of DG sets, change in fuel type, alteration of hazardous waste quantity, or operational changes will not be treated as amendments. These must be filed as fresh or revised consent applications with applicable fees. Applications outside the permitted list will be rejected at the SRO level.
