Background

Environmental protection law refers to the legal framework designed to prevent, reduce, and manage harm to the natural environment caused by human activities. Its emergence is tied to increasing industrialization, population growth, and resource exploitation, which highlighted the need for regulatory intervention to safeguard air, water, soil, forests, wildlife, and ecosystems. Over time, scientific awareness of environmental degradation—such as pollution, deforestation, biodiversity loss, and climate change—pushed governments worldwide to adopt statutory protections, set standards, and create enforcement mechanisms.

Applicability

These compliances are applicable on:

  • Establishment having Effluent Treatment Plant (ETP)
  • Establishment having DG Set
  • Establishment covered under Air (Prevention and Control of Pollution) Act, 1981
  • Establishment having Sewage Treatment Plant (STP)
  • Establishment registered under Factories Act
  • Establishment registered under Factories Act
  • Establishment providing drinking water
  • Establishment discharging waste water
  • Establishment having Pressure Vessels
  • Establishment registered under Factories Act

Periodical Compliances:

  1. Periodic Testing of ETP

Testing of Effluent Treatment Plant should be conducted at periodic intervals.

  1. Periodic DG Noise Monitoring Testing

Testing of DG Noise Monitoring should be conducted at periodic intervals.

  1. Periodic Ambient Air Monitoring Analysis Report

Analysis of Ambient Air should be conducted at periodic intervals.

  1. Periodic Testing of STP

Testing of Sewage Treatment Plant should be conducted at periodic intervals.

  1. Periodic Lux Monitoring Testing

Testing of Lighting Levels in a factory should be conducted at periodic intervals.

  1. Periodic Testing of Stack Emission

Testing of Stack Emission Levels from a factory should be conducted at periodic intervals.

  1. Periodic Testing of Drinking Water

Testing of Drinking Water Parameters should be conducted at periodic intervals.

  1. Periodic Testing of ETP RO Waste Water

Testing of Waste Water Parameters should be conducted at periodic intervals.

  1. Periodic Testing of Pressure Vessels

Testing of Pressure Vessels should be conducted at periodic intervals.

  1. Periodic Ambient Noise Monitoring Analysis Report

Analysis of Ambient Noise should be conducted at periodic intervals.

Penalty & Punishment

  • If the ETP is not tested periodically, it may result in:
    1. Non-compliance with Consent to Operate (CTO) conditions,
    2. Discharge of untreated/partially treated effluent into water bodies,
    3. Failure to maintain prescribed standards;

which may result into penal provisions of imprisonment or fines levied under Environment Protection Act.

  • Violation of environmental norms and can attract penal provisions of imprisonment or fines under Environmental Laws, as DG sets are regulated for both air and noise pollution
  • Non-compliance with environmental laws and consent conditions issued by the State Pollution Control Board (SPCB) will attract penal action involving imprisonment or fines under environment laws.
  • Non-compliance with Factories Act which will attract penal action involving imprisonment or fines.
  • Failure to conduct stack emission testing at prescribed periodic intervals is a violation under environmental laws, attracting penal provisions under the Air (Prevention and Control of Pollution) Act, 1981 and the Environment (Protection) Act, 1986, especially when mandated by the Consent to Operate (CTO) issued by the State Pollution Control. The penal provisions may involve imprisonment or fines or both.
  • Failure to test waste water (effluent/sewage) at periodic intervals, as mandated by environmental regulations or Consent to Operate (CTO) conditions issued by the State Pollution Control Board (SPCB), is a legal offence in India and may attract penal provisions involving imprisonment or fines or both.
