Revised Delay Charges and Relaxations for QPR Submission under Rajasthan RERA

Notification/Circular No. – F.1(167) RJ/RERA/Auth.Meet./2019/1166 dated July 31, 2025

Applicable Act/Rule: Real Estate (Regulation and Development) Act, 2016 & Rajasthan Real Estate (Regulation and Development) Rules, 2017.

To address practical challenges faced by promoters in filing Quarterly Progress Reports (QPRs) and to rationalise delay charges, Rajasthan RERA has issued a revised framework, superseding the earlier order dated February 24, 2025.

 Revised Delay Processing Charges for QPR Submission:

  • Promoters will be allowed a 1-month grace period after the end of a quarter to submit the due QPR, without any charge.
  • A delay charge of ₹5,000 will be applicable for QPRs submitted after the grace period.
  • If the QPR is still not submitted by the end of the immediate next quarter, an additional ₹5,000 will be levied for each successive quarter until submission.
  • These charges will be capped at a maximum of ₹3,00,000 per project for all pending QPRs.

Illustration:

  • For the quarter ending December 2024, the grace period ends on January 31, 2025.
  • If submitted between February 1 and March 31, 2025, the charge will be ₹5,000.
  • If delayed further and submitted by June 30, 2025, the charge becomes ₹10,000.
  • Additional ₹5,000 will apply for every subsequent delayed quarter.

  No Need for Interim QPR Submissions:
If the promoter misses submission across multiple quarters, they are only required to submit the latest QPR, and not all missed ones. However, delay charges for each missed quarter will still apply.

  Strict Action on Non-Compliance:

  • If a promoter fails to submit three consecutive QPRs, the system will auto-initiate suo-moto non-compliance proceedings.
  • Such cases will be dealt with separately and may attract penalties as per legal provisions.

  Pre-condition for Approvals (CC/OC/Mortgage-Free Letter):

  • Applications for Completion Certificate (CC), Occupancy Certificate (OC), or Mortgage-Free Letter will not be entertained unless:
    • All due QPRs/APRs are submitted, and
    • All applicable delay processing charges are fully paid as per Clause 1.

  Special Provision for Completed Projects:

  • For projects that have already received CC or Mortgage-Free Letters, delay charges will be calculated as per Clause 1, but with a reduced cap of ₹1,00,000, provided the last due QPR is submitted.

  One-Time Relaxation till October 31, 2025:

  • Promoters are given a one-time opportunity to clear all pending QPRs and submit CC/OC/Mortgage-Free Letters by October 31, 2025.
  • In such cases, a relaxed maximum cap of ₹2,00,000 will apply on the total delay processing charges, regardless of the number of delayed quarters.
